What is the difference been EB2 Vs EB2 NIW and when does one qualify for NIW
National Interest Waiver means that you do not have to have a job to petition for EB-2 GC. Consequently, there is no labor certification requirement. NIW petition is your petition; not some employers.

The visa bulletin says "Effective Monday July 2, 2007 there will be no further authorizations inresponse to requests for Employment-based preference cases. All numbers available to these categories under the FY-2007 annual numerical limitation"
But doesnt that mean that no I485 authorizations will happen but filing can still be done and EAD received as de facto?
Please ask your respective lawyers to clarify this with USCICS/DOS.

Hello Friends,
I have a question regarding waiver on J2 EAD.
My husband is doing residency on J1 since last 9 months. His residency program is of 4years and plans to do 1 yr fellowship later on on J1 so total of 5 yrs
I m now on J2 and have an EAD with me.
My questions are:
1. Do I need to do a waiver job after I complete my residency on EAD before joining any other hospital here in the US? or it just applies to my husband(on J1) to do a waiver.
2. If aftercompleting my residency on EAD, if my husband gets a waiver he will be on H1 and me on H4and if the same year I get H1 fellowship program for 1 yr, can I change my status from J2 EAD to H1 without doing a waiver?
3. How much time it normally takes to renew your EAD?

Guys, I am efiling 765 for EAD renewal. last year, my lawyer filed 765 and sent a G-28 along with that. This time, I am efiling on my own, do I need to send the G-28 ?
also, please let me know if photos are required to sent after efiling 765.
my AP is expiring sometime in mid Oct and EAD is expring on 30 Sep. I am efiling EAD on 30th of May, can I do the same for AP though, it will still be more that 120 remaining for AP?

PERM (labor certification) process is a requirement from the DOL and has to be fulfilled by the employer. The employer will have to bear the costs of this first step in GC which includes (filing fees, recruitment process, lawyer fees etc). It is illegal for an employer to seek this compensation from the employee. Expenses incurred in I-140 and I-485 need not be compensated by the employer.
In your case, it seems that the employer is ready to help you with all the documentation but is not ready to bear the expenses. You will have to explain to your employer how the GC Process works and the requirements of the PERM process.

I was on H1 visa and laid off from job on 10/30/09. I got severance pay for Nov. and have the pay stubs. I applied for COS from H4 to F1 for my spouse (already in collage) and H1 to F2 for me on 12/9/09. Meanwhile immigration performed spot check at my ex-employers on 12/3/09, so they came to know that i was not working. My employer had not revoked H1 by then. Our COS application was received by USCIS on 12/14/2009, case is currently under Initial Review.
- Will the immigration officers who did spot check inform USCIS that i was out of status?
- Will case get rejected due to delay in applying for COS?
- Will there be any complications in transferring my H1 to new employer as i was out of status for about a month before i applied for COS?
- How to stop F2 COS if i get H1 transfer approved first?

LC was approved in 08-20-07 but I-140 was not filed within 180 days according to new rules. has any body have this problem? will DOL or USCIS let it slip. please help.

I was wondering if there is a way to efile for renewal of EAD & AP or do we really need a lawyer. It is turning out to be too expensive to file for a renewal through my comany lawyer. If it is possible, can someone who has already self filed advise of the procedure?

You must submit the 485 through a lawyer if your priority is current, check the visa bulletin. You can always file when 140 is approved and you are still employed with same employer. You can also file EAD & AP for work permit and international travel. Get a lawyer asap.

New employer will file the labor after 3 months (HR Policy)..I have good relations with previous employer, they are ready to file I485. Is it possible to file I485(previous employer), while I am working with new employer?
I am not sure but I came to know (not reliable source), that it is possible to file I485(previous employer) and during the interview, I can submit a support letter from the new employer. is this correct?
