Just imagine this, you spend 6 months training an international grad, spend $5000 - $7000 per H1B and after 1 - 2 yrs, you will have to start all over again. After a couple of months, the "new hire" will just be angry at you (just look at all the people on this forum who curse bodyshoppers - and just to clarify - I am not implying that the company you start will be a bodyshopping firm) and he will quit your company and join someone else. And you will have to start the process all over again. The guy who you hired on H1B will be now join someone else and depending on your business, you will be left high and dry.

CIR is going to be back for sure no doubt about it and when it comes back it is going to be the same bill. Harrry Reid is just creating a drama so that he can reduce the number of amendments introduced by the republicans. There are currently more than 30 to 40 amendments remaining, with this drama harry reid is trying to reduce the amendments to about 5 or 6 more amendments.
We should try something like applying for 485 without priority date but even the cantwell cornyn amendment does not have this provision
Has anyone tested it by fluke. What happens if we apply? Have the papers been sent back???? Maybe they ll overlook the date and it might get thru..if I had a i140 approved I would have definitely given it a shot..

Hi,
1. I am on L1 with current company A(with current i-94 expiring in Nov 2007). I got my H1 approval this year from consultant B and they got the I-797B. This document shows the validity from Nov 2007-2010. But I have heard people get something called I-797A which has a new I-94 attached to it and in my case it is not.
Here are my questions.
1. Can I start working for consultant B from Oct 1.(after quitting the company A with L1).?
2. What should I do since I have current I-94 only till Nov 15th 2007 and if I ask my current company A to extend it they wont do because I want to leave them as early as possible before Oct 1st.
3. Can my consultant file for the change of STATUS from L1 to H1B(the approval for which I have already received from USCIS) and then in that case it will have new I-94 attached.
4. Another suggestions what should I be doing so that I can start working on H1 after Oct1st here and then whenever I go back to India, after 4 or 5 months I will have the Visa stamped.

I saw a petitioner recommend GT law in one of the posts. I think she is a lot luckier than me. I have had very bad experience with GT Law recently. Please see the following facts:
1) After 3 months, I was only informed that my salary is not meeting the prevailing wage requirement; 2) After 6 months, I was told that the attorneys are still struggling with the job description themselves without asking earlier for a conversation with my manager to help them resolve the problem. The issue they are struggling is that the field of my advanced degree is not related to the field I have been working in even if my skills sets fit right in!!! Can you believe it that we are actually advising them how to handle this issue and paying them a lot of money???? 3) During the 6 months, the attorneys have been changed twice and the transition of my case from 1 set of attorneys to another was very poor (I was asked for the same set of documents twice). It seems the process started all over again with each change. With the most recent set (the 3rd) of attorneys, they sent my files to the Maryland State to assess my salary level last week after we were informed about salary issue 3 months ago by the 2nd set of attorneys. It has been really a big mess. It has also shown that different sets of attorneys are definitely not talking. 4) When I check with them once every two - three weeks about progress, they would never give me a clear or meaningful answer even though they responded pretty quickly. They don't even want to tell me what has been the maximum processing time of all the labor certification cases they have handled. Now, after 6 months, my job advertisement has still not been launched yet and I have no idea when it will happen. BTW, GT Law is contracted with my company and I am required to use them for labor certification. Now I'm thinking I will have to change to a different company if I want to get it done quickly and successfully.

I absolutely do not agree that it will do more harm - given the current situation where every country is backlogged in EB3, and EB2 for India/China is also severely backlogged, there is very little chance that India and China can have more than 10000 visas (7% of 140,000) issued in Fy 2006 across all of Eb1/2/3.
Current System
EB1 China/India might benefit a bit because they will be the first ones to get the visas from extra EB1 visas but then, if Specter/Frist's bill passes, many of these EB1's will get a chance to file for 485 anyway.
EB2 China/India might also benefit a little bit provided rest of the world leaves something behind.
EB3 will not benefit at all as every country is backlogged here.
Looking at FY 2005 statistics is very misleading. So, the way things are, any bill is better than no bill at all - at least we have a shot at improving the status quo we are in.
Instead of just comparing current situation with future, especially when the future is so unclear, we should try our level best to achieve the following
1. Put the clause back
2. Amendment to file 485 after 140 or labor has been approved for certain time but Visa number is not available. Emphasis should be on the total wait time for GC, so that people in BECs do not get screwed.
Put all your energy and efforts in achieving these and we will not see retrogression for many years. My goal is not to dissuade people from the comparison - it is a healthy exercise, but now that we know what the pros and cons are, let us work together to solve.

I called USCIS and she said based on the information she got from his authorities, she said all the 485 application packets will be rejected with a note saying that , please apply after oct 1st if your PD is current.
I also asked her if you dont send us back by oct 1st what sould we do, she said if I dont receive by August mid, then take infopass and go to local uscis office and request for my application back.
I think all the customer service agents are aware of the issue and got informed what to answer for our questions.

Readers are sending us email inquiry whether the USCIS will reject the I-485 application for the June 2007 current cases for them which they post marked and shipped out via US Postal Services or via overnight delivery services which was delivered on July 2, 2006. These cases will also be rejected as under the revised July 2007 Visa Bulletin, entire EB visa numbers will remain unavailable effective July 2, 2007. Since filing of I-485 is not determined by a post mark but by physical receipt of the application, these cases are likely to be rejected as it physically arrived at the Service Center buildings on July 2, 2007 when the unavailability of the EB visa numbers took effect.
If the June application was shipped out in June when their visa number was current and delivered on June 29 or earlier date, the application is considered timely filed unless there were flaws in filing such as missing filing signatures, defective checks, or even missing important initial evidence. These applicants should preserve the overnight delivery tracking certificates and the cancelled checks of filing fees to prove that the applications were timely filed before July 1, 2007. Issuance of hard copy Receipt Notice does not control for the purpose of the proof of "filing."

If USCIS realizes their mistake and revokes an approved I485, will they also take the necessary steps to restore the previous status of the applicant? i.e. H1/H4/AOS/EAD or what ever the wrongly approved person had prior to the approval mistake?

I guess it depends... I would prefer to slog with weather in Canada for 3 years and get citizenship instead of stuggling for 4-5 years with desi consultanting company to get GC. My sixth year is about to start in december 2009 and employer has told that they will not sponsor GC. I am planning to take citizen ship from Canada and then move back to India. That way, anytime I want to come back to US/Canada doors will be open. I guess, there is no right or wrong answer, its a matter of choice.
In fact, I also thought like you. I decided to do an MBA , so out of that 3 years 1.5 years were used up by my MBA.

Don't you guys think there is no spark anymore in IV? Have you heard anything incourging from IV lately? Where is QGC or whatever there name is? Where is money?

The updates are provided periodically on forums from IV core. We are currently working on the House side for pushing SKIL forward. There are a few things missing in SKIL bill that we would like to get introduced. Mainly its the 3-year extensions of EAD and AP and 3- year ext of H1 for labor applicants that is missing.
We are also trying to assess of SKIL in house is gonig to go forward, and in the event it doesnt, what other bills can be vehicles for putting our provisions like the S 1932 style.
We try not to restrict free voice and opinion from members on forums however, if it gets downright nasty we will edit posts and censor. But in principle we try to avoid it as much as possible.
If you have questions, and if you think that IV core is not up to the job and needs help or needs to pace up, or if you think you have questions for IV core, please pick up the phone and call the 281 number listed on the website's "Contact Us" and call us. We will answer ALL your questions as to what we are doing.
That would be much more productive way of finding answers to your questions.

Suppose Company A filed for visa cancellation on 11th June, Monday. Please let me know if there would be any problem in filing for H1B transfer now as Company A has filed for cancellation before i file for H1B Transfer.
I have seen in other posts that you have about 2 weeks to get a new job who will file for transfer. But contact an attorney and if you cannot change job immediately then consider change of status to F1 or another status.

How we are getting 50k is like this.
1) EB1 Over Flow (50% of EB1 was unused last year) 46k/2= 23k
2) EB2 Over Flow , this number is still fuzzy. But lets say around 10k.
3) EB2 India has quota of 3500.
So approx 40k.
Correct...This is a new thing starting this year. And as long as this interpretation holds good, we will see similar excess numbers available to EB2 India/China - until they become current.
Then these numbers will pass on to EB3 ROW
Then after that category becomes current, numbers will start flowing into EB3 India/China.
But all this is assuming, the number of GC applicants per year is less than 140/2.5 = 56K/Year + their interpretations do not change again.
I for one, would not be surprised to be see EB2 India move to 2007 next year.

I was looking at the AP renewal instructions. It says:
1. If you are in the United States, you must attach:
a. A copy of any document issued to you by USCIS showing your present status in the United States; and
b. An explanation or other evidence showing the circumstances that warrant issuance of an advance parole document; or
c. If you are an applicant for adjustment of status, a copy of a USCIS receipt as evidence that you filed the adjustment application;
d. If you are traveling to Canada to apply for an immigrant visa, a copy of the U.S. consular appointment letter.
So what I gather from this is that they need:
a) Our H1B status papers and the previous copies of the advanced parole documents.
b) A letter stating why we need the advanced parole.
c) The I-485 receipt copies.
Now it DOES NOT say anything about the photographs if you are filing within the US.
Can someone who has applied for the Advanced Parole (NOT the EAD), please share their experience and what documents are needed. The EAD filing seems to be elaborately covered.
