I doubt if the house is going to toe the senate line on the CIR. The new bill that has been introduced in the House is seen as a rebuke to Bush, directly contradicting the Senate version. I think this CIR will be killed in the house if it somehow passes the Senate.

Got the same letter from USCIS asking for $5000. If they are asking all the people who sent this request the this kind of money... I wonder how much money they are expecting from this "Program Writing" thing??? IV and We all have to question this insane tactics and this needs to be exposed to press and politicians. I don't think Murthy or AILA or some others do any benefit to us it is already proven many times.

Does anybody know how long an H1B visa can remain valid (including grace period) after a layoff ? What I know, is an H1B technically becomes invalid the day you stop rendering your services to your employer. The firm's lawyer suggested me to file for B1/B2 visitors visa to avoid going out-of-status.
If I do that, can I transfer my H1B visa (from B1B2) once I get a job? Or will I have to struggle against some quota?
Can anybody suggest a good lawyer in New York City or near Hoboken, NJ who can help we with all this? I tried contacting Cyrus Mehta, but he seems to be booked for another week.
Btw, thanks for the overwhelming response to my request for resources to find a job. While I am evaluating my options, please keep me in consideration for any openings that you see.

Technically there is no grace period. Get a job ASAP and you need 2 pay-stubs for transfer.You can even do without pay-stubs but you may have to go out for I-94. Best way is to transfer to B1/B2 and you can come back to H1b without any problem.

I want to thank this european who got his greencard 2 weeks back but still attended the rally. There may be more heroes like this. I was in a group of people when we spoke to him, didnt catch his name as i was encouraging bypassers to honk their cars to support our cause.
He is over 6 foot, in immigration voice t-shirt and blue jeans. He is swedish...Please share his name if anybody knows....

The reason I was there was because my green card process was a painful and stressful experience for 5 years. And I was still one of the lucky ones! I don't want to put anyone through the same agony, not even my worst enemy. I really feel for the people still stuck in the mess.
I talked to a Polish guy who had been here 9 years fully legally and could not leave. He had not seen his family in 9 years and did not want to risk going back just in case they would not approve his H1B in his home country. They are very strict there it seems, because none of his family members or friends could not even get a tourist nor visit visa to see his graduation. Shocking!
I was glad I showed up at the rally just to hear all the peoples' stories.
Most people who did not show up probably think they are ok after applying the i485. They will join IV rallies, when they realize how wrong they are. People have applied for i485s years ago and still don't have a green card...

There was another russian gentleman who got his green card 6 months back and is a student now. Yet, he had driven 3 hours from NJ just to cheer us. He mentioned that he understands how painful this process is and wanted to encourage us by attending.
I met an Indian who got his green card in year2003. Still he attended to give moral support to IV. Hats off to all those guys who made it to the rally even after getting there GC's. Hopefully those people who are still stuck in the GC mess realize the importance to actively participate in the events organized by IV.

Well, all I know is that they are still accepting I-140 applications. I am sure they will continue to do so until the bill is passes. (If it will pass)

Ksvreg, you are in a good position and may not be in a hurry to get the GC. You may not want to port and and may want to stick around until your PD becomes current. The only reason you may want to port is if you want to be done with the process. But may not be worth the risk. It is your personal choice.
People who are frustrated are the ones from 2005,2006,2007 onwards ...... who missed the 2007 Fiasco for whatever reason. Now EB2 (Oct) 2005 is current but EB3 2005 is far away.
They do not have EAD like you, and will not get EAD for looooooooooong time(think 10s of years) unless they port or immigration reform comes along.
They can cut down on the "wait" time by 10-15-20 years if they port. I guess that would be a good and sufficient reason :)

The H1B visa belongs, in effect, to the company that sponsors it. You cannot work for any other company on that visa other than sponsor. If this is a transfer, then, In a so-called "visa transfer" what actually happens is that the initial visa is cancelled in favor of another one issued for the new employer. What that means is OP's work with old employer is considered as "unauthorized work". Do not consider this as illegal presence, as his legal presence is controlled by a valid I-94.

Write to USCIS simple explanation and show a proof such as HR letter stating your presence on active payroll continusly for all the term and run it through attorney, if you have. Else put together logically framed chronologically ordered history. Attach W2's for the years and demonstrate un-broken timeline.
If their is nothing to hid or falsify, ... don't worry about anything. Good news is your case is active. People here ( no offense to anyone) will split hairs trying to answer simple issue. Keep it simple and truthfull and nothing adverse will happen.

You are missing the whole point. If it was the way they worked it's fine, or if that's the way they are going to work that's fine too. But the only reason this was being done so fast is to churn out the maximum pending EAD's with 1 year approvals, so they come back to us with $340 checks next year. If it wasn't greed than they wouldn't have put point 5 and made EAD free only for post July 30 filers. If they were really loaded with application they would have done 2 years AP too.
And don't talk about India here. We are the people who paid peanuts to study Engineerings, doctorates etc from world renowned Institutions. We harldly pay for any services provided by the govt. And above all, what are we doing in return to our countries since we left. We never even bothered to go back and check how's our motherland doing.
I feel we don't have any right to talk about India....

Basically H1 is done for LCA which is to make sure that American worker is not is replaced for for the purpose of low wages. Such an attestation is not there in H4. They cannot deny the H4 unless documents are not clear. But H1 they can deny for other reasons. Basically to make H4 not able to work is also a kind of protection for american workers. But it is strange that l2 people can work but H4 cannot work. One cannot fight every law because more provision we ask more delay will be there. IF Skil bill is passed in current form most of people will get gc within 1 or 2 years.

I called USCIS and she said based on the information she got from his authorities, she said all the 485 application packets will be rejected with a note saying that , please apply after oct 1st if your PD is current.
I also asked her if you dont send us back by oct 1st what sould we do, she said if I dont receive by August mid, then take infopass and go to local uscis office and request for my application back.
I think all the customer service agents are aware of the issue and got informed what to answer for our questions.

This is in response to the poster indicating that H1B cap includes h4 time. This was changed in the 2005 interim AC21 memo which decouples h1b and h4 visa status durations. H1 Time does not include time spent on H4. Anyone on h4 can always get a new h1b term for 6 years.

I am sure we are all rejoicing and this is surely a cause to celebrate.
But, the battle is not over yet. I hope once most of the members get their 485/EAD applications rolling, they will get back on track and fight for the real objective. To obtain our green cards in time!! Dont forget the wait is NOT over yet...
I am sure we all are going to be a lot rejuvenated and continue fighting retrogression with greater zeal..
Just to set the record straight even I benefit from the visa update, but I hope we dont slow down at this juncture...

Expectations are so high. Unless they workout compromise it may take long time to pass CIR. The risk is democrats want more relaxed CIR than 2006 form. We have to see how republicans will react for that. Also How skill bill form this year? Depends on that only CIR fate will be decided

Congress, as last year is determined to amalgamate us with the illegals so they can freely oppose the bill and indirectly kill both kind of immigration. I think we should put all our resources towards lobbying and make as many friends on the hill as possible.

My friend has a similar situation.
He transferred H1 to Company B and worked for 5 weeks and descided to come back to company A (He is 100% sure that Company A didn't revoke / calcel his H1 and he has valid H1 till 2009).
IS this OK?
