I would love to attend the rally. However my financial condition at this time does not permit me. I could have booked a ticket on my credit card but all my cards are max out!
You want to know why I am in this financial deep hole? Well, I have two sons in college and paying out of state tuition, that is over $17,000 per semester for both of them.
My wife on H4 could not work until now that she has an EAD. It is retrogression that I should blame and I would love to do all in my power to obtain relief or bring the issue to the attention of the American public.
In my own way I have contributed to IV both in cash and in kind. I have told me story in countless media interviews. I only wish I could do more for IV financially but alas I am not able to do that at this time.
I would be in the rally in spirit....only I wish I could attend in person.
We can help! We want to make sure as many people as possible come to the rally. Those in worse financial positions can take advantage of the many generous offers from other members who are willing to sponsor others.

For all those who don't believe in IV - First, thanks for giving me all those reds :) I guess that is the best you can do anyway besides complaining about IV. Second, if I understand it correctly you want to be associated with IV but on your terms. Every organization has a goal and it's own way of doing things. Take for example the companies you work for. There are lots of things that we don't like about our companies; do you go complaining about those to your board of directors?
Transparency? The only transparency I have and I need is that IV is the ONLY organization looking out for the highly skilled community.
The solution to this is simple like I said before - If you don't agree with IV's way of doing things, what is the need to come here and corrupt the minds of those who believe in IV. Please take it somewhere else. We promise we will not miss your business!

If USCIS realizes their mistake and revokes an approved I485, will they also take the necessary steps to restore the previous status of the applicant? i.e. H1/H4/AOS/EAD or what ever the wrongly approved person had prior to the approval mistake?
I am also worried. I called my attorneys office to inform them but of course like always he is in a meeting. I am sure this was an error but I am hoping its not call me optimistic but I like the smell of green card :)

Now thats unfair .... you are just using one part of the quote to distort the entire post ... The discussion and context of that statement was always on categories.... and was using that sentence as an example on categories...
The assumption was that readers would understand categories over individual qualifications/countries of origin in this context
If you destroy the context in which a statement is made it makes the entire post "look" bad and is disingenuous

I used AC21 but was lucky to get RFE only. Thank God.
It is not worth unless you get double or at least 50% rise in pay.
Else don't go that route.

Looking back, do you think it was worth making the job move using AC21? Is it really worth the time, money, anxiety, sleepless nights that you go through during NOID-MTR?
For people getting layed off, they have no choice but to use AC21, but for rest of us, why not continue with the job you are currently in and let the GC take its turn rather than risking it?

CIR is going to be back for sure no doubt about it and when it comes back it is going to be the same bill. Harrry Reid is just creating a drama so that he can reduce the number of amendments introduced by the republicans. There are currently more than 30 to 40 amendments remaining, with this drama harry reid is trying to reduce the amendments to about 5 or 6 more amendments.
We should try something like applying for 485 without priority date but even the cantwell cornyn amendment does not have this provision

This is all happening because of labor substitution. I don't think there are that many people from 2001 and 2002 still continuing with same position. But now since labor is getting cleared from backlog companies use it substitute to other candiadtes and priority date never moves forward.
Why cannot they just terminate labor substitutuion. It is really unfair to those who are waiting in line.

I really can understand how you and the thousands like you feel. Let me however point out something. All those who got to file the 485 now have just put their name in the que. When you join the que by filing 485 you will move much ahead of most. Having said this, I still feel that this is not a proper way that USCiS should be handling cases and we should send a strong message that when there are cases to be dealt with they shouldn't be ignored and over run. I am not affected by this situation and am neither a beneficiary of this July bulletin, but very very strongly support your point. Please consult with IV leaders and get their opinion on this issue. They have been fighting for all our issues and I am sure they will have a plan of action to deal with this too. Wishing you all the best and hoping all our members support you. I have been thinking about whether to attend the rally or not from past few weeks.
Attending the rally would require me to take a day off. Finally today without thinking twice I just went to my manager asked if I can take day off on 9/18 instead compensate the work in the following saturday. It was approved and I am attending the rally on 9/18!

Fragomen employees are told they represent the company. The company is their client. They are a corporate law firm. There are instances when the law firm represents you, the foreign national. Usually this is when you are applying via a marriage based case, or are in the final green card process and it has reached portability. There is information that law firms cannot release to you as some information requested belongs to the client, and they must receive authorization from the client. Yes, I used to work for Fragomen, before anyone wants to assume anything. I was a paralegal and worked hard for every case that was given into my hands. I specialized in the green card process and made sure I responded to every foreign national as quickly as I can. Please understand that paralegals and legal assistants are subject to the attorneys they work for. Therefore, some questions you may ask require an attorney to respond, and the paralegal or legal assistant's delay may be in trying to get the answer you require. I know not all Fragomen offices work the same. Not all will respond to you in the same manner. Some may be worse than others. So if you are going to defame Fragomen, would you please try to specify which office you are referring to?

To those of you who have had negative experiences, I am sorry that your case went to someone who only looked at their work as a job. For me, each one of my foreign nationals were special cases, each required as much care and concern that I could give them. None of my cases were ever denied. I wish you all the best in this process. I know it is a long and, many times, frustrating process, especially with countless delays due to either the law firm, your company, or the government.
And for the person who had asked about the prevailing wage, it comes from the state employment department, not the federal government. Some offices work faster than others. When a prevailing wage comes back higher than what you are making, the law firm then has to go back to the employer to find a resolution, which can mean either an increase in the salary once you have received the green card, or confirmation that is what you will be making at that time, or a reduction in the requirements, which can sometimes take a case from EB2 to the EB3 visa category.

To pbojja, your post shows how you may have completely misconstrued my post. I haven't written the post out of frustration of not being EB-1/2 at all. And am I dreaming when I hear you say that good English speaking skills aren't important in the U.S? Maybe I am in another world. I said clearly that the 'fraud' desi firms and their employees have tarnished India's image. They should be removed from the system and we should be in line with 'genuine' cases. What's wrong with that? Where's the unfairness here?
To snathan, I understand your post but I believe the tone should be more friendly and amiable. And I certainly didn't give you any red dots so peace on that front. I don't believe in petty playground politics. Actually I appreciate you reminding people about contributions since they are needed a lot for our efforts.

I may not need to tell you this but you are dealing with most greedy, money making machine in US govt. System. This organization churned out 200K EAD last year in 1 week, just so that they don't have to issue 2 years EADs. This org. is rejecting I-485 to get $1000 MTR fees, they will not spare any chance to take money from your pocket. I would say Instead of asking them for the fee waiver and wait 3 months for their 'NO', just give them the 5K and move on...
While it may seem that USCIS/DOS does what it does for increasing their cash-flow, real reasons are just those applicable to any government organization. Their demand for $5K was just a thoughtless response, which may always be their first response to all such public requests. The fact is that, what is sought should already be available for their decison making. Case should be raised with Ombudsman, for bringing out inefficiency such as this, in regard to crucial information needed for determining monthly cut-off dates, and forecastings. Ombudsman's office loves information on such systematic poor govt operations.

They did a good job. My only complaint with they kept changing the paralegal that was handling my case like 3 times during the whole process. Otherwise no problems.
Canada rules are not complicated at all. You don't need any agent for doing paperwork.
Either you are eligible or not.
