    Good morning,

    If you pay a closer attention, I don't start threads. I just reply to messages following that topics you started. The real issue is that many members in this forum are so biased that you cannot take a different view.

    For example, yesterday many in this noble forum became so uneasy and angry as soon as I mentioned that shift from democrats to republicans was triggered solely by the disatisfaction with the Iraq war. It turned out that Bil O'Reilly last night said the same thing. That is based on facts, because exit survey according to O'Reilly, did not indicate that people voted against Republicans due to other issues such as immigration. Then I went on and even showed articles from liberal newspapers such as The Nation to confirm my sources. CNN published e-mails from several voters on why they voted against republicans and immigration was not even mentioned in that sample. If you do not want to believe that and prefer to follow other views, that is fine. My point is, I won't get mad with you. I won't request that administrators shut you down. You have the option to do so. However, saying that my analysis is off base and I bring here unrelated topcis is not true. There are reputable people out there who agree with me. Grow up and learn how to deal with the reality.

    What amazes me is that those are not fundamental issues for you to discuss and get so mad about. Who cares now on why people voted republicans out? For you and me it matters that we take you greencard and move on. I feel that it is my way to contribute when I admonish you about distorted views. Bringing that level of critical thinking may strength your maturity and knowledge and that can certainly increase your skills in the fight for immigration relief for the employment based immigrants.

    I guess we have to wait for the June VB to be out before people realize (once again) that something needs to be done. Nothing is for free. It will quite a while (if ever) before we get to 50K at this rate :(

    Good News indeed, but to be frank it just doesn�t excite me even a bit. After being stuck for over five years and getting nothing at the end, I reserve the right for myself to be skeptical and pessimistic!! :-( --Sorry
    There are certainly anti-immigration groups like IEEE/US and others who will use every weapon at their disposal to sabotage legislations like SKIL BILL etc., but the reality is that US economy is increasingly becoming dependent on foreign-born skilled workers and by gradual exit of baby-boom generation out of economy this trend will accelerate.
    I hope Congressman Senssenbrener doesn�t dismiss the legislation. It is just unfair to link the immigration issues of Merit-Based Immigration Applicants to border security.

    People feel as if they have achieved something big after getting an EAD. EAD is not a visa and EAD status is not a valid status. You in fact lose your h1b valid status once you invoke AC21.

    I have personally seen people change their attitudes as if they have achieved a gold medal in Olympics and talk big about "'Fingerp[rinting", about AC21, as if they have written the AC21 law. Does anyone know how AC21 came into picture on the first hand? There was an advocacy group called "Immigrant Social Network" that was behind the AC21. Prior to that, EB rules were extremely stringent with no portability.

    Everyone browses this website, gains knowledge and behaves as if he/she is an immigration expert and has achieved something big.

    We have been cajoling people. To what extent?

    Words cannot describe the amount of effort "needhelp" has been putting in. She still continues to be the same and claims that her morale will never go down and her commitment levels have increased. All the cowards, and so called smart asses - try to learn some good lessons from people like her.

    Life is not all about shopping at Macys, talking about fingerprinting, and watching TV, and spending hours on phones talking about how dealstobuy is different from buy.com or not about how CVS pharma sells the same item for less rate than rite aid. Life is not all about "sitting here doing nothing and talking about how different countries are rising and why one MUST not care for his own good"

    IV is a volunteer organization and every member is equally responsible member. If you try to elude, and act smart - it only reflects your dirty character.

    If you are here, do something. Yes, atleast something that you feel you can do. Please do not cheat those who are working extremely hard for your cause.

    U know what, actually we all eb2 guys are very sad about the eb3 plight. And if we do get a visa number, we will request uscis to dsitribute it to eb3 category. does this make u guys happy now ???

    why dont u think abt those guys, who filed in eb3 earlier, knew that the trouble is brewing, and switched jobs to be able to file under eb2. why you guys dint do that so far. dont blame uscis. they were, the are and they will remain a mystery for ever. its not our birthright. if DOS thinks they need more research grads, they will keep eb1 current, if they need more exp guys, they will improve the b2 category. And if they need more frsh grads, they will come to eb3. And if some exp person is stuck in eb3, he himself is to be blamed. dont blame anyone else for your ignorance of GC rules then.

    So fact is we all are under DOS/USCIS mercy. 2 years back it was eb3 turn, now it is eb2 turn. Unfortunately no is blaming why ebI is always current. if that reason you can digest, then you should have the gall to digest this one too.

    Ok, this thread is degenerating. I had told nothing against EB2 other than saying that we cant be happy for anyone given our situation. We are not asking for any pity, or asking for you to be sad for us. You being (or anyone) sad for us will not make us happy. You "asking USCIS to give us your numbers" will not make us happy either.

    So please stop saying things which is obviously trying to make light of our situation. I see that even though most EB3ers are talking about why the law changed and if it is reasonable for the law to have been reinterpreted, *most* EB2s are responding at a personal level.


    BTW: DoS does not make the determination if they want more or less of Eb1, Eb2, and Eb3s. The law does that. Also note that it wants all 3 categories in equal quantities -- when there is sufficient demand.

    how much was the fee for paris T visa?

    60 Euros. Same price as a short term Schengen visa. So if you can get a short term Schengen visa (the consulates are empty in the US FYI) visit some places in Europe as part of a layover (ironically cheaper to get 2 tickets instead of a transfer) and then travel to India. Skip duty free in Europe as it's price gouging.

    If you are so sure about this, why don't you consider spending your own money to get initial professional consultation. May be that will enlighten you. Many laws don't apply to Immigration Laws, so what you have written has no meaning.

    Answer just this question - Can an H1-B worker claim that he/she should be sponsored for green card just because his/her coworker has been sponsored? Just think about the answer and may be you will see the reasoning.

    People here are mixing different laws without knowing each law's applicability limitations.

    Trying to apply AP for spouse, his last entry into US was on F1 but since then he's been through H1 and current status is AOS filed. Should the Class of Admission be F1?
    Whatever he used last to enter US, in this case F1(class of admission will be mentioned in the i-94 stamping

    Which I-94 copy should be attached, the one that was stamped when he last entered US, or the latest I-94 he received from his last H1 filing?
    I would attach both copies to be on safer side and avoid any RFE's,however i have never sent i-94 copies. Please take a look at my blog for list of documents/cover letter for AP. Hope you find it useful

    It's slow poison.. Great deception. You can't get it and You can't let it go. After waiting so long (7+ years in GC road) I got nirvana. One early morning I think over back and relies what the hell I did with my life and career for this stupid card. So I put my energy in study. Hoping to complete MBA by summer and move forward. Waited so long so i don't have any more patience or emotion left. I have to move on with life.. :p

    Have a cup of coffe, it is sprint break time, I am taking my daughter out....also I am going to meet some friends over this weekend.

    This EB-2, EB-3, ROW, India, China..... only hurts me when I think about it! As long as I am busy with my day to day life.....life is beautiful.

    Before others trying to guess which country I belong to, I want to admit that I am from India.

    The point I am trying to make is about the categorization of the Employment Based immigration, which in itself is proof of the differences between categories (including the EB-5 or the Religious category) as identified and classified by the USCIS/DOS.

    It is altogether a different matter as to what exactly a person classified in a particular category is doing in his/her job.

    I would like to question what qualifications some of the CEOs in this country have, who draw undeserving remuneration from their companies. How many of the Bear Stearns employees are immigrants, both who will still be working and those who are already fired or are likely to be fired soon? How may of the those sub-prime loans are taken by illegal or legal immigrants?

    Before starting to question me as to how my post relates to immigration, I request every body to critically think and then respond.

    This is not just "frostrated" but silly socialist thinking too. What has "joining hands" or "new comers with fake experiences" got to do with porting.

    If you can port, then just DO IT and spare yourself the pain.... why wait for "en masse transfer to EB2 by porting" or talk about "ethical reasons" and then lament after the fact ???

    I am already in the porting phase. My EB2 labor is in process. I just hate to see those still in EB3 hoping their day will come. They need to port their applications right away, or those with recent filings using fake experience will be ahead of them coz EB2 gets processed first with all the spill over.
    And I would rather help them than someone like you who would not even disclose your info. You are a clear example of someone trying to walk the walk of the illegal aliens.

    And what makes you think it is silly socialist? Unless you are one of the new graduates with a bachelor's degree with 5 years of experience on your resume.

    Good you are in your late 20's. I am in my early 30's. Even 1-2 years makes huge difference for this GC. If I had the qualities of Gandhi, I would have not been here in this forum. Dont forget to call him as MAHATHMA Gandhi. I dont think there is even one MAHATHMA's here. All here are poor ATHMA's. Humans are great in adapting to any given situation. If a guy foresees that he cannot survive without knowing swimming, he will somehow learn that otherwise he is going to die. On other hand, the best swimmer in the world also cannot afford to swim for years just because he knows swimming. If you drop him in ocean with others, may be he will survive for longer time but he will seek for a life jacket or rescue sometime or later.

    My whole point is everyone starts with optimistic approach when he starts. Show me one person who lands in US with pessimistic approach. You, me and all of our friends landed here with great vision for our life and career. The situation, surroundings, family issues, other personel issues drag him little by little to pessimistic way when he does not reach his set goals in time and instead stinks in the same spot having the required qualities to further his/her career and family.

    A question for you: I know you will get married if you are not now and may have one kid at least at age 35. What will you be doing if you are here then without filing for 485. Will you have the same LEVEL of optimistic thinking? Answer honestly.

    I am in my late 20's and am going to finish my 7th year next month...you decide how many feet of water I am in..:rolleyes: Meanwhile I totally understand your argument that the situation is the most frustrating for people who have been here the longest. I'd say sharpen you swimming skills and then it wouldn't matter how deep the water is or how tall you are....I's say stick with it and endure hardship if you value the end result (GC ofcourse). Even if you decide to go back...whatever your age/experience be...never forget its never too late..Gandhi was 46 years old when he returned to India from SA after spending 22 years there..Still wasn't too late for him to start a revolution now... or was it ?:)

    I am also, stuck in this whole BEC debacle. Mine is Oct 2003 EB3 and still stuck in Labor. And the very fact that the FY 2008 quote availability is very uncertain and we might not be able to apply for I-140/485 for years now makes it even more frustrating.
    I am new to this team, so please tell me what I can do anything to help this issue to be raised.

    I am one of the victims here. I filed my labor on August 2002 EB2 and it is still waiting in the backlog center In-Process. I (w)hole-heartedly support for this...i guess we should send flowers to backlog centers...

    although "technically" it is the congress (both the house and the senate) that makes legislation, a.k.a. any new laws or amendments to existing laws when it comes to immigration matters, the role of the president, especially a popular president cannot be underestimated.
    If the president decides to throw his full weight behind a particular bill or treaty (as happening with the US-India Nuke Deal), he can (especially a popular president in his first term next year, whoever he may be) influence a lot of congressmen/senators to rally behind such a bill. In that regard someone with a bi-partisan reach can garner even more support from both parties.
    That is why it is IMPERATIVE that whoever the next president will be, that he is SUPPORTIVE WHOLE HEARTEDLY for legal immigration.

    My case with PD of Aug 2002( EB3) was stuck at PBEC until May 23, 2007. PBEC had closed my case multiple times, and had to really fight to get it reopen and finally certified. I have sent emails to Sec. of Labor ( Elaine Chao) twice. Her office was helpful in opening my case. I got reply from her office within a month too. Also, I mailed senators too. Try to talk to senators from your states. I know and understand the pain of you guys, whose cases are stuck at BECs. Personally, I feel that you guys should mail Sec. of Labor, and let her have the attention of these cases. This is really injustice!

    If that is so then why isn't any Employment Based amendment in the list. and how does shusterman know. There is one from Sen. Mendez that gives more points for family but nothing for employment based.

    the writer's of this bill have said that any amedment that removes the merit system is a deal breaker. So far at least from whatever info is out there seems there is nothing for employment based category. Don't know if something is going on behind closed doors...
