For President immigration is one of the important issue but not the top most priority. In that high skilled immigration is a part of the immigration. EB reform is just a very small for them compared many challenges in the country. But any President will not Veto any high skilled immigration bill if passed in congress. So congress needs to be satisfied in this issue. I think congress has more power in dealing with immigration.

When I came to this country and started following politics closely (12+ years ago), initially I was fascinated by all the discussions and transparent process etc. But over the years got convinced that its all a facade - election process here is as much flawed as in a "third world" country. Election 2000 is the biggest proof. Even worse, here people are easily swayed by non-issues. Media creates hype and media creates perceptions about a candidate, real issues and concerns takes back seat most of the times. Just see now - for last couple weeks everyone is talking about a VP candidate - the power of a VP is limited but yet everyone is talking about her and almost forgot the presidential candidate of the same party. The republican favoring press wants to project her as the next savior (which unfortunately seems to be working) and whip up their cadre. The democratic favoring press wants to project her apparent inexperience etc. We may soon see who is going to win in their "spin". In general republicans are pretty good in spin stories and project an apparently dumb candidate as someone with "whom you can have a beer with" and get him elected; now they might even succeed in projecting a 30+ year senator who backs current administration as an agent of change !!?!!! and people might even fall for that argument. Of course there are spin stories on the other side too.
Anyways, whoever wins this time - I think our situation wont change much and might even get worse. As the economy get worse - it would be very difficult to get any new bill favoring us (note I am talking about EB green cards not H1B). There is already a good effort by likes of numbersusa and programmers guild to project HR5882 as if it will kills jobs. As we know HR5882 is only for recapturing unused greencards the beneficiaries of which are mostly in this country already. It should have been a completely non-controversial bill - if we can see the resistance its facing we can imagine about any other bill that propose increase of GC numbers or something such. So prospects for anything better happening is very poor irrespective of who the next president is - that's my reading on this.

If its a transfer, your I-94 "number" will be same. Check to see if you have same I-94 number on any or all or atleast 2 of your I-94's including the one which they provided you at POE "across" any of your employers (1, 2 and X).
You can also check the application receipt date on them.. see if they are around April of those years? Most probably they will be new filings if the receipt date is around April oppose to September or November.

I am amazed in the solidarity just by seeing the responses. But if i think deeper, this rally is not for some national cause or for some greater benefit.
Every single person here is doing this for one's own SELFISH reasons. Why then are we talking like we are marching to save the planet or save the poor animals going to slaughter or human trafficking or AIDS prevention or even the war in Iraq.
Yes, we make things easy for people down the road (however that is not our true intention, our true intention is just about how to get the card faster) but trying to pull in more people to the rally by playing on people's guilt is not the approach. You say it like you see it. We want people to come so I CAN GET MY GREEN CARD SOONER. Thats all. So everyone has the same motive...thats all. Nothing more or nothing less. Everyone is going for A SELFISH INTEREST...nothing based on higher principles of duty, sacrifice or to ensure higher morals of life. Everything is for sensual enjoyment.

I was also told that there is new law which requires that the PERM fees should be paid by the employer (around 5-6k). Most desi consultancies used to ask the employees to pony up the labor fees. wonder how this will affect the conversion process.
I called couple of Desi consultancies..and they told me that lot of thier I-140's aqre getting rejected in this conversion drama...since they are looking for finanacials of the companies and looking for $3 mil of profits..? well do you have anybody who successfully converted from Eb-2-3 please IM me which companies I could contact...

Just because ppl are able to file 485 does not mean that they are going to take a number out of the quota for that year. The numbers are only taken during approval and hence they would all still be stuck in the same queue and you would have gotten an oppurtunity to file and possible get your GC too...take a deep breath, relax and think about this with a cool mind. I definitely do feel bad for you. My labor was stuck in BEC too and i left my company and joined a new one and restarted all over again. Been on H1 for seven years without ever getting any chance to file 485 until now...

I am in the same boat too. But I am not sure if we have a whole 1 month to file 485 based on July bulletin.
The press release by USCIS says that, whoever falls under July Bulletin have the whole 1 month to apply. But if we dont get receipts before July 30th, we may not fall under July bulletin and so we would not be able to apply.
From what I understood, if we get the receipt before jUly 30th,we are good, or else we have to find an alternative to apply before July 30.

Thank you for writing to me regarding our country's immigration system.
Our nation's immigration and border security system is broken and must be fixed. We must require illegal immigrants to step forward and become legal and we must better secure our borders. We must restore the rule of law and enhance security at our borders. The Congress and the President must work together to reform our laws. We also must use the full force of the law against employers who hire illegal immigrants.
I support changes to the law that will require illegal immigrants to become legal. They must pay taxes, learn English, and pass criminal background checks. This process won't be easy or quick, but it will be fair and practical. Individuals who came to this country illegally will be bumped to the back of the line behind those who waited to come to this country legally. And illegal immigrants with a criminal record would be deported. Those who refuse to register and meet these conditions also should be deported.
To secure our borders, the government should require the use of a biometric entry-exit system for all land borders, so that we have an accurate record of who is entering and leaving the United States. We should create a "smart" enforcement regime which will produce more efficient inspections and screenings, and allow us to target and tailor our limited resources to combat illegal smuggling of people and contraband. I supported recent appropriations that provided $1.6 billion for border security fencing, infrastructure and technology, and facility construction, as well as the hiring of 3,000 new Border Patrol agents.
To meet the needs of our workforce and promote family reunification, we should set in place realistic immigration numbers and policies, and clear the backlog of legal visas, green card legal permit resident and citizenship applications. Senator Feinstein has introduced the "Agricultural Job Opportunities, Benefits and Security Act", S. 1038, in order to provide for new blue card visas and modify the H-2A program. Senator Mikulski has introduced the "Save our Small and Seasonal Businesses Act", S. 388, to extend the annual cap exemption for returning H-2B workers. While these two bills address key issues in the immigration debate, a comprehensive approach is the only way to adequately deal with this issue.
We can no longer ignore corporations who are hiring and exploiting illegal workers. This practice takes jobs away from Americans and depresses wages for everyone. These unlawful companies must be prosecuted and face stiff criminal and civil penalties. We need smart policies like improved border patrols, full enforcement of our laws, and requiring illegal immigrants to become legal.
The status quo is not working. Allowing 12 million to hide in the shadows and live in this country illegally is unacceptable. Our system must be fixed. McCain interview with Judy Judy Woodruff & Richard Stengel, Richard asked something like - what about the green cards for the highly skilled immigrants educated by American Universities. To this Sen. McCain replied implying - they should be given green cards sooner, I am not sure if they could be given automatic green cards but the process should be faster.....
He said it not exactly in these words but implying something to that effect. They were suppose to ask Sen. Obama the exact same questions. Did anyone see Sen. Obama's answer to the question about green card for high skilled immigrants from Richard Stengel? Just curious....

The student visa provision on adjustment of status says that it applies to everyone who would have been in that position if the new visa would have been in place when they graduated - i.e., it is retroactively applicable. In addition it clearly says that it is applicable to students who join an accredited graduate program in STEM to obtain an advanced degree. The contrast with Specter is clear - Specter's markup clearly mentions PhDs, where Frist's bill only mentions advanced degrees. I really haven't mentioned the 1 year provision and the $1000 provision in my earlier posts. Those are givens.
If you can tell me why I am wrong looking at the bill text, instead of from a bill summary posted by someone else, it would be a lot more helpful to everyone on this forum.

what makes you think people participate in those? from personal experience
in the MN chapter, it's hard to even get replies to e mails, forget meetings etc. of late though i'm glad to say the MN chapter has really beugun to pick up again.
ask the tri state guys how much effort they put locally- meetings- fliers- phone calls, all by a handful of volunteers. so all this is good in theory and yes it takes time. but the apathy (even hostility) that was encountered was frightening. ask chanduv23 someday what the tri state guys went through...
