I said I am not defending IEEE....so where the question of praising comes?
I've read the document. IEEE is supporting "Immigration Visas" but not H-1B visas(temporary).
Can you shed some light what they meant by "Immigration Visas"?
It would be great if you can give us an example of some one coming on "Immigration Visa" and becoming a permanent resident and subsequently a US citizen.

indianabacklog, did you make your video and upload on you tube? you know about 2 action items posted by core right? you people are the right one who should stand first in the line to show our problems. I really appreciate if make a video along with your family.
Nice idea but does anyone honestly think the DOL cares. I am somewhat fortunate that my 2002 labor finally got approved in the middle of 2006. My son is not so lucky since he turned 21 while I was waiting. When my senators office took the matter of my son aging out up with the DOL I was told to put him on an F1 visa and send him to college so he can REMAIN (he wants to LIVE here, big difference) in the United States. These people do NOT care what they are doing to your lives. They do not care that my son has NO path to permanent residency any more and that I have to write the enormous check for his tuition twice each year so that I can still have him in the same country as me and his father. I feel awful for anyone still waiting for their labor certification but at least you will eventually get in line for your green card and will get ahead of those filing now with much later priority dates. You are indeed victims but I just wanted to point out that there are thousands of young adult children who have had their hopes for getting a green card totally shattered by this backlog center fiasco.

Would the employers exempt from "Immigration and Nationality Act" in any way?
I see so many job postings restricting with "US Citizens" only...

With this info, your attorney can easily demonstrate that you were authorized to work for "Employer 2" at all times since last entry in the USA until date of filing for I-485.
There is nothing to worry about, IMHO.

There is something with the french language it self. All the people who speak french as their native language, tend to be a$$holes, of varying degrees. 01. If I-140 is revoked by the previous employer after invoking AC12, does the status of I-140 changes? Any LUDs?
02. How long does it take to revoke an I-140 after the employer sends the withdrawal request?
usually you get an LUD on 140 and 485 at same time. When does it happen? Depends, for some people it happens after a few weeks for some, few months.
In my case it happened on Aug 5th whereas my ex employer informed me he is requesting revoke on July first week. Apparantly - the same time my 485 also seemed to be being processed because they sent FP notice to my wife and NOID to me, we are JJuly filers and never got FP notices. When I called customer service, they advised that wife can go for FP and I have to respond to NOID and advised me to respond ASAP to continue with the case. My response reached on Aug 25th and I saw soft LUDs hitting my case continuously for 3 days - guess it is with an officer, but never got my FP notice though my wife completed it.

Just received confirmation of 4 more letters which takes me to 200!! Going to shoot for 250 and will send most of these new ones to NORCAL, will send final batch close to March 1st. Keep them coming folks.

Yes, we need more help from the media. That is why we have the media event - press conference on Tuesday June 8th. We need members to be there to show a good representation of EB-Community. Apart from that we need to send these emails/letters to media and the reps in 1000's everyday, so that we get the attention we deserve. Thank you everybody that is participating and sending emails every day. We can also print out and send letters.

Not necessarily getGC. I am EB3 but i am a Masters from the US. Sometimes for fresh hires lawyers play it safe by applying in EB3. I had emailed someone at competeamerica.com and they had mentioned that an "advanced degree" is either a masters or a PhD. You mentioned that you had an engineering degree from India. Is that a B.E. or an M.Tech/M.E.? If you have a master's degree from India, you need to ask ur lawyer if that qualifies as an advanced degree.
But even otherwise, it still benefits you, coz say even 20-25% of Current EB3 have master's degrees, they will be out of the queue and you will be benefitted. I know it doesnt sound like a benefit, coz it is not a direct one, but if you look at it from a different angle, you will see it.
I agree with you eb3_nepa. It is not a fact that everyone in EB2 category has an Advanced degree and also not a fact that no one in EB3 category has an advanced degree. So, this bill will benefit a bunch of EB3 and EB2 folks directly and indirectly.
BTW, I am also in the same boat as you are. I have a Master's in Engineering from the U.S. But I am in the EB3 category.
Sen. Bill Frist's bill is definitely a win-win situation for a lot of parties. It doesn't include the Guest Worker program as well as it includes all the major provisions for EB legal folks.
Now lets just hope that it passes the Senate and House (more critical) without any unnecessary bureaucratic delays.

I called again, took me less than 2 minutes. To all the people who have already made these calls, please call again and maybe address yourself as your spouse's name, or friends name. The point here is volume.
To all those who haven't called shame to all of you, please return back to India as your stall actions are bringing a disgrace to our country.
The Senator has not made any stand on this issue yet, it is imperative for all of us to call, please call.

There are two ways to react once you are not getting any result .
1. Do not do anything and blame others . Proclaim your leadership inabilities and hope a new avatar will come to save you . ( May be Lord Vishnu can take his final incarnation and save us , let us chant and pray :-)
2. Do something like say contribute and spread the message .
One will care about IV only if there are valid business reasons for doing so . Lots of my colleagues does not care about IV because they do not care about retrogression , reasons are ,
A)They may buy pre approved labor and get away with it .
B)Their spouse also work ( on h1b in IT or on h4 in sabji mandi ). Their spouse is a home maker and do not intend to work.
C)They are simply saving money to go back to india and does not want a GC.
Now even if you are impacted by retrogression still you may dream that in the dream land of USA one fine day congress will wipe out your worries . That indeed may party happen but still the legislature may pass something which can screw up the situation more , like say enforcing hard cap on the per country quota .
So it may make sense to help IV and not leave everything on luck or congress .
But above all rationale there is the warm fuzzy desi feeling of getting things free when people of IV are slogging , so no wonder people do not help IV , desi mentality rules :-)
