There are total 27 EB3-I approvals on since Oct'2008. In 6 months, only 27 approvals is not a good number.
Does anybody know why USCIS is not touching EB3-I aggressively and are we close to using all EB3-I for this year already?

Good News indeed, but to be frank it just doesn�t excite me even a bit. After being stuck for over five years and getting nothing at the end, I reserve the right for myself to be skeptical and pessimistic!! :-( --Sorry
There are certainly anti-immigration groups like IEEE/US and others who will use every weapon at their disposal to sabotage legislations like SKIL BILL etc., but the reality is that US economy is increasingly becoming dependent on foreign-born skilled workers and by gradual exit of baby-boom generation out of economy this trend will accelerate.
I hope Congressman Senssenbrener doesn�t dismiss the legislation. It is just unfair to link the immigration issues of Merit-Based Immigration Applicants to border security.
Please let us know what we could do to help the process.

1. Let us decide how we need the data. ie what query USCIS has to run
2 make publicity of this .. ie uscis is an agency which should have the data but it is asking us to pay 5K for the data. (president, hillary clinton, aila and whoever else,...)
3 Only getting this data one time wont help us. Like USCIS processing dates , they have to run our query every month on a particular date and publsh it. Otherwise after 6 months or one year we have to pay this money again.
4 Can we appeal to the money asked by USCIS. Anyone who knows more about FOIA
5 Can we request USCIS to give us the table details and tell them we can write the query/program free of cost.
Any other suggestions..

I agree with most of your post, but to state that 5yrs of wait is not a catastrophic delay - you have to be really very patient, and frankly unimaginitive to know what you can do with your green card.
Going forward, only people hit with retrogression will wait for 5-7 years. And if you look at the percentage of people getting a green card, a large number of them will get it in a couple of years, while the rest of us will suffer the nonsensical country cap.
Companies hire individuals not only because they can get the job done, but also because they see that the individual will evolove in his/her role going forward. Which company will continue to keep you in the same position for 5 years, doing the same thing day after day? You have to be just dumb enough not to get promoted and with zero ambition to succeed.
Understand that we are stuck. This is not what we want.
Historically, 5 years for end-to-end GC process is not considered as catastrophic delay...
There is a good chance that 2005 PD might get approved in 2010 summer , even with current system unless USCIS looses more visa #s. So IV and all of us have to scream at high pitch and frequently so that no more Visa #s are lost. I think it is happening
2003 this summer , 2004 in 09 and 2005 in 2010 is quite possible.
Now if we all contribute more $$$ to IV we can expedite the above time table.

To make aware people around you that we Legals retaining US jobs in US itself and how we are contributing to US economy will work big way to us...
I work as a free lance s/w consultant & when ever I say I am on EAD for last 4 years, they usually ask how come I dont have GC for so long!! Thats the time I make them aware, how legals are law binding, tax paying community etc..etc...and that "DO" works..and they say that "Ya, this Congress/Goverment is working on "Illegals" but not on Law abiding Legals..!!!
Can we work on those lines.? To spread a word & make community aware that "Legals" are sufferes in the process of this political debate of "Illegals"?

I have applied for EAD for myself and my wife (receipt date June 3rd). Wife EAD is laready approved on 06/27 (no LUD at all) and I see a LUD on mine on 6/12.
Hope they can wait till monday for my application atleast.

Does this Bill and all associated Amendents get the new introduction date or it will basically take over from the Last Bill and Amedments. I am asking this question because last bill saying 140 after May 15 will be invalidated. Is thi still valid for this Bill? or they are gonna use tomorrow's date.

I dont know the whole background...but they say they will use 5000 unused visas per year. Where do these unused visas come from? FB visas?
Ironic if it FB...that is backlogged years - close to 10 years for some categories and there are unused VISAS....God I cannot understand this..ONLY IN AMERICA THING I think.

Following the July2 fiasco, my 140 was sent to TX Service Center on July 10, received by them on July 11.
Not received Receipt notice yet. Anyone else who filed with TxSC in July get a receipt yet? Does only the lawfirm get a receipt or also the employer? How long has it been taking TxSC to send receipt notice in the month of July? llot of discussion about NSC but I didn't see any mention of TXSC.
My lawyer tells me there may be some clarification from USCIS next week about filing 485 with just a receipt number (from a cleared check) or with proof of Fedex delivery; for now confusion prevails about whether or not such a 485 application will be rejected. Lawyer is not sure if cleared checks will reach them before 4 weeks from the bank. They don't seem able/willing to find the eCopies of the checks on the bank website. Some people mentioned employer sends the check, i think the lawfirm does?
Wonder if anyone has any views on refiling 140, but concurrently with a 485 this time? Has anyone tried this? Does the Labor certification letter you personally got not count as original LC? Only the one sent to lawyer counts as orig?

Why H1B, F1, etc.?
Whenever US allows a person/family to come in US on work/study, US should provide equal opportunity to that person/family in most aspects of life (except National Security, Voting Rights, etc. which is after becoming citizen).
If at all any binding required, it could be somthing like six months - not of years and years.

Just imagine this, you spend 6 months training an international grad, spend $5000 - $7000 per H1B and after 1 - 2 yrs, you will have to start all over again. After a couple of months, the "new hire" will just be angry at you (just look at all the people on this forum who curse bodyshoppers - and just to clarify - I am not implying that the company you start will be a bodyshopping firm) and he will quit your company and join someone else. And you will have to start the process all over again. The guy who you hired on H1B will be now join someone else and depending on your business, you will be left high and dry.
I know this because the very first job I joined, the philosophy at the company was to hire fresh grads (the "get them cheap" works for American Grads too). My boss used to tell me "we can get two for the price of one". The year I got hired, the company recruited 15 new grads (a new "Product Development" dept. was being started) - and I was the only H1B. After 14 months, when the business started picking up, the company did not even bother to raise our pay or even recogonize us. Guess what happened? Over a period of 2 months, 12 of us quit for better jobs. Guess who now had to look for 12 people and at the sametime deliver the product to the clients on time?
If I understand your argument then you can conclude that: faster EB GC processing will decrease wage supression.
However, Kim Berry (in One Easy Fix For Immigration (http://www.businessweek.com/bwdaily/dnflash/content/jun2007/db20070620_915353.htm)) is saying that faster EB GC procesing will increase wage supression.

population has become hostile to the whole concept of foreign engineers/IT workers. Companies like Infosys, TCS hire 100% IT staff from India etc.
(saying that no US citizen/GC available...thats like lying in broad daylight)

they affected the local job market to a far lesser degree so the opposition
is less.

There's no doubt CIR is going to be brought in this year. How much of it or any of it will get passed, is the issue. Congress, as last year is determined to amalgamate us with the illegals so they can freely oppose the bill and indirectly kill both kind of immigration. I think we should put all our resources towards lobbying and make as many friends on the hill as possible.

I understand - I took it all as a healthy debate, I certainly didn't intend to offend anyone. Its been one of the most interesting debates I've had in a while. Hermione, I sincerely apologize if any of my posts have been interpretted otherwise.
I agree completely with Hermione. Look at the data. It is clear that USCIS is processing applications "quickly" (I quote the "quickly" because I mean relative to other bureaucracies).
The average time for processing (not including NC, since that isn't within USCIS control, is approximately 120 days). The goal is 180 days, so they are meeting targets (you can argue about the target if you like, but in Canada the processing is more like 220 days).
The stupidity of giving more and more money to USCIS to speed-up processing, when they are already meeting the targets can not be overstated. The problem is not with USCIS, it is with the fact that there aren't enough visas, and that NC process can take years. If you want an answer to "the problem" you need to make sure you are asking the right question...
Of course, USCIS management doesn't complain about the additional funds they keep getting (what self respecting bureaucrat would?).
Quite frankly, I have dealt with many bureaucracies in my life, and USCIS is amongst the most efficient I have ever encountered (I am not sure if they are efficient per dollar spent, but ignoring what they cost, they deliver pretty darned good service for a government agency).
If users keep (wrongly) insisting that USCIS is the source of the problem, then congress will keep throwing more money at them (and USCIS will happily accept it), and that little slice of the time that USCIS is responsible for will keep getting smaller, but it won't do you (or me) any good, since the lack of visas is the real problem.
