Is it possible to upgrade from EB3 to EB2, if person is working on EAD after AC21 is invoked and H1 is expired?
I believe it is possible if your company is willing to do it. Having said that, you would be better off asking this question to a qualified lawyer.

I agree with OP that we should know what's going on. But at the same time there is nothing called free lunch in this world. I suppose some guys in this forum have lot of time and energy to vent it out on each other. We won't achieve anything with all this fighting... but seems we are best in altercating with each other. Some times I just wonder whether folks out here are really skilled immigrants (gimme red dots)?? We should better do something constructive..

USCIS promptly waited for everyone to submit AP & EAD application to move the dates forward!!!

Is the overall work something like 100K that they have divided by the number of requests to yield 5K per request? Unlikely. I think they just sent standard 5K demand to each FOIA request to shut it down.

I got a relief. So since I ma on EAD and on I-485 status is it ok to take a break for 3 months and then start the next job. So this break will not affect my status right.

It does make sense that the overflow numbers are given to higher preference categories in single state oversubscribed countries. When you think about it, will that not be the most beneficial to United States? Who would you prefer .... and Unskilled professional from a ROW category or a skilled worker from an Oversubscribed country. I would gather it would make more sense to give the opportunity to the higher skilled since the benefit to US will be higher
The more I read this form, the more I become disgruntled with this community! To say that someone from a lower class of visa and not from an "Oversubscribed country" (and I am assuming you mean India) is less skilled and less deserving than someone from a higher class and oversubscribed country is ludicrous to say the least. Each and everyone of us (and I mean "legal immigrants") have our own skill sets and contribute equally to the American society. As long as we are competent at what we do, then we are all SKILLED in our own way. The only real defining difference among the visa classes is the level of education not skill. To suggest one is better based on education alone is arrogance and nothing else!
The U.S. immigration system is not without its flaws and despite the delays and frustrations, it is FAIR! The per country limit is to ensure that citizens of ALL nations have an equal opportunity to immigrate to the U.S. and not just a select few. The only thing that I have found unfair as far as immigration in this country is concerned is the politicians' focused efforts to do something for the "illegal" immigrants at the expense of the "legal" immigrants.
We are all in this together and the insults and innuendos that dominate this forum divide us so let's stop them and focus on the real issues!

USCIS reps did not mention any specific group to me. But what I was told was that, everyone's information should be in the USCIS system by August 1st. So urs would be too.

Going back to India is not a bad option at all, but it is really subjective to each individuals about what gain we are going to get out of gaining GC or citizenship from US or Canada like settling down in these countries for good or moving back to country of origin later. In my opinion gaining citizenship from US or Canada before going back to India will be always advantageous, one future perspective these countries have bilateral agreements with other developed nations where you can travel without visa for business trip or for even jobs where you're treated differently as against India citizens(Asian origins doctors who work in UK know this difference). Its a known fact that the pay structure in Gulf countries are different based on the citizenship.

Appreciate your realastic advise, I believe its worth one dies in canada for citizenship. I would say CANADA is a great nation and citizenship is widely respected, on top of everything you are widely allowed to any country.

Thank you everybody that has contributed. We need to raise $50,000 in the next 15 days. That is $3334 raised every day. Now even though this looks like a big amount to raise, with a collective effort we can do this. This is our chance to make this happen for ourselves. The alternative is just staying in limbo renewing EAD/AP every two years for atleast the next 10 years. That is an average cost of $800 every two years every member.
We need 17 members everyday contributing $200 everyday or 34 members contributing $100 everyday for the next 15 days.

1. Let us decide how we need the data. ie what query USCIS has to run
2 make publicity of this .. ie uscis is an agency which should have the data but it is asking us to pay 5K for the data. (president, hillary clinton, aila and whoever else,...)
3 Only getting this data one time wont help us. Like USCIS processing dates , they have to run our query every month on a particular date and publsh it. Otherwise after 6 months or one year we have to pay this money again.
4 Can we appeal to the money asked by USCIS. Anyone who knows more about FOIA
5 Can we request USCIS to give us the table details and tell them we can write the query/program free of cost.
Any other suggestions..

Thanks AskBird, My only concern is if the new EB2 labor or I140 doesn't get approved for some reason, can I fall back to my current EB3 application. I don't want to jeopardize my current application just by deciding to port to EB2. Any suggestions?
