As so many members have posted there is no such thing as H1 transfer. If OP continued to work for employer# 2 without joining employer X that is fine as long as OP's employer 2 did not revoke the H1 petition. So OP should be fine , all he has to do is point that he did not accept employer X offer and decided to continue with current employer (i.e. #2) and his work with employer 2 was authorized based on the continued validity of h1 petition of employer 2. Now I saw that OP mentioned somewhere that he used EAD when his H1 with employer 2 expired. This could be a potential reason for the RFE. Here's my take on it:
When OP's H1 ultimately expired there were two possible work authorizations which OP could have used : Join the employer X on H1 since that employer did not revoke the h1 petition even though he did not join them OR used EAD with either employer 2 or employer X. The OP got this RFE for I-485. If you are doing AOS from H1 the burden is on you to prove that even while your I-485 is pending you have not engaged in unauthorized work. I just feel that the IO is doing an extensive scrutiny of the OP's application and trying to make sure that OP did not engage in unauthorized work at point.
In any case the OP should get a good lawyer.

I agree its a great idea, still most of crowd don't understand what are we asking and relates us to un-documented workers.
Even within legal community most people who are pre-gc stage (H1/LE Etc) they don't have any interest; ppl came to me at work after rally to tell me that they are 4-5 years away from my situation so they didn't feel attending rally. Bigger the better, we need big crowd, NJ/NY/MD/DC/VA are worthless. We can try doing rally in Houston, TX area, we may find dedicated people there. But I feel it will be very tough to show heads rally in big numbers.
On our next rally (hopefully soon) we should all carry placards but this time with ONE single slogan:

Alongwith permission for H4 to work, there are several other problems that legal immigrants face in USA. However, lets face it ... its always a small set of people who are fighting for their green cards. After a prolonged wait, once they get the GC, they move on with their life, forgetting their own ordeal in the past, and ignoring the future problems of fresh GC aspirants in the queue.
Even the fresh GC aspirants who come to USA on H1/L1 visa, do not understand the importance of staying on top of their GC application and start organizing themselves. Mostly they realize the gravity of situation couple of year after their arrival, and start venting their anger and frustation on immigration forum like this.
A majority of immigrants think that the immigration doors should shut down immediately after they get their GC's. This transformation takes place overnight. I have never heard that from such a large population of immigrants who are settled in USA, anyone ever raised their voice supporting the legal immigration.
Lets face it ... its an unjust world ... we have lots of problems as far as legal immigration is concerned. But how many of us who are boiling with frustation here, will ever work and spend our time and energy on immigration related issues once we get the green card/citizenship?
BTW, I am just throwing some light on the basic root cause of this problem... no war of words please ... just peace.
Just think, it will be hard for a GC holder to continue the fight. After waiting for many frustrating years, he will just want to put the unpleasant thoughts behind and move on, and make up for all the lost years, they will have other things to do. That�s the reality, you got to fight for yourself along with people who are in the same situation as you.

I dont think it is 9,800 each. I think it is 9,800 combined - 7% of 140K. To that extent the 21500 number in my earlier post stands revised down to 17,700.

I called USCIS and she said based on the information she got from his authorities, she said all the 485 application packets will be rejected with a note saying that , please apply after oct 1st if your PD is current.
I also asked her if you dont send us back by oct 1st what sould we do, she said if I dont receive by August mid, then take infopass and go to local uscis office and request for my application back.
I think all the customer service agents are aware of the issue and got informed what to answer for our questions.

I would love to get a free lunch but facts are facts. I will not argue with you or about you but when and if you can refute ANY of the following statements, do write back and we can have a healthy discussion on this forum:
1. Why does Walmart/Gas station charge me money? I pay for a service or product I want which they give and have irrefutable proof that they gave. IV has no such proof of anything it has done for anybody individually or as a group on this forum.
2. You buy bandwidth and free lunch by donating?? NO. Do you see that big ad for a lawyer splashed on every page? That is what pays for the bandwidth. Many "non-donors" answering questions for each other in this forum or just by the act of engaging in fruitless discussions with you is what is paying for the bandwidth.
3. You seem to be under the impression that IV got the visa-bulletin reversed??? Moses, wake up and smell the roses. The massive class-action lawsuit being pursued by AILA, the Silicon Valley lobby pressuring Zoe Lofgren, almost all immigration lawyers asking people to join the class action .. what about all of that? Do think your 25 bucks on the flower campaign is what got the bulletin reversed?

This is all happening because of labor substitution. I don't think there are that many people from 2001 and 2002 still continuing with same position. But now since labor is getting cleared from backlog companies use it substitute to other candiadtes and priority date never moves forward.
Why cannot they just terminate labor substitutuion. It is really unfair to those who are waiting in line.

I guess (just by reading posts on IV) one point which came out pretty clearly was that IV has good support in some regions and really very little support in some others (support as in visible support, where people are willing to show up for rallies, contribute to IV�s efforts etc), I guess this pretty much means that we need to focus on building the regional chapters of IV, like have strong/formal leadership and goals of each of the chapters.

Agree with you 100%. Instead of 'forming' state chapters in the last moment, they need to be established, nourished, strengthened and developed over a period of time. A grassroots movement needs strong roots in all regions.
I was also thinking that we can possibly learn a lot from the protests by undocumented immigrants. They had record turnouts in their rallies and most of their people stayed away from work to take part in the efforts when ever there was a call for the same.
With all due respect, it was a disaster. They ended up scaring Americans - by holding Flags of thier countries, holding US flag upside-down or disrespecting US flag in other ways. This provided fodder to anti-immigrants to scare Americans of an 'invasion' of law-breaking aliens.
We need to learn lessons from them, in not committing their mistakes
Some of the advantages of having simultaneous local rallies is that
1) No travel expenses � (So that we can spend more money on media and lobbying than travel expenses)
There was a Free Bus from NY/NJ. Yet, how many came?
2) No need to time spent on travel � ( Better turnouts)
How many people from DC participated?
3) Comfort � every one can just go to a local rally point (Better turnouts)
Those seeking 'comfort', will choose it at home. What better comfort than to sleep on a couch and watch TV?
4) Stronger regional chapters � (work at grass root levels)
If wishes were horses...
As of now, idea doesn't look good. 10 people marching in Detroit, 20 in Minneapolis, 40 in New York, 100 in California - will it even be a rally, in the true sense?

If Air France was genuine they should have made everyone stay in the same place or atleast talk to theie department of immigration and arrange a temporary supervised visa and take all people to the hotel.

I wonder at what point of time this "three years of U.S. work experience" applies from. Is it that you should have 3 yrs exp when you applied for labor or is it when you apply for 485??
If you have an approved visa (I-140) and 3 years exp then you can apply for adjustment of status (I-145) . Because of the virtue of your 3 years of US work exp you are exempt from the availability of visa numbers (quota). Labor doesnt come into play here, you still have to have an approved I-140.
This is my understanding and I don't think this amendment will see the daylight.

I remember in one of Dem party primary debates there was a related question on immigration (general immigration) - Obama answered that in positive way and in fact brought up the legal/employment based immigration issue on his own and mentioned that it needs to be speed up the process and make changes so that fresh talent is attracted - ofcourse at the end he added that american interests have to kept in mind while coming up with employment based immigration system (I remember gist of his response not the exact one)- but his whole response was very positive and if I remember correctly none of other candidates even mentioned employment based immigration - they answered generic immigration (meaning illegal) issue.
Does this mean anything - not much. As someone already mentioned both candidates are in favor of legal employment based immigration and increasing it to some extent - or atleast give some token support for this. But both of them may not take any active stand to make it a priority item - because there are other issues that people (their voters) care more about now like war in iraq, economy, gas prices, health care etc. etc. Both of them may not touch immigration until later in their term. Inevitably when they do touch it - it will be in the form of CIR and it will be big can of worms. Presidents can set the agenda and may issue limited administrative orders - but the expectation that either McCain or Obama will come out for EB community and unilaterally increase the quote or issue an admin order to solve our issue is IMPRACTICAL - and wont happen.
Our best bet is something to happen thru Congress. And our best bet is thru some relatively non-controversial bill like HR5882 (not CIR) - yes its a stop gap measure but it does solve many of EB issues until a new CIR comes into play. If you remember the golden days of EB in early years of this decade are because of a similar visa recapture in last days of Clinton administration - we need something similar.

And our best bet is thru some relatively non-controversial bill like HR5882 (not CIR) - yes its a stop gap measure but it does solve many of EB issues until a new CIR comes into play. If you remember the golden days of EB in early years of this decade are because of a similar visa recapture in last days of Clinton administration - we need something similar.
