I got an email from my law firm, that my packet was refused to be accepted by USCIS.
I received the email from my law firm (Monday night - July 2) that:
Please note however your case was sent to Nebraska last night and did arrive - we tried!
Which means mine was sent or reached NSC sunday night or must have been hand delievered early Mon morning. Don't know exactly what happened. I just trust them!!!!
I didn't bother to ask my law firm further details. I will ping them first thing monday morning and try to give any update I get. I hope they have some proof of the refusal!!!!!!!............
If it was sent Fedex, DHL or UPS, ask for the tracking number. You'll be able to trace if it was really sent to USCIS or not.

I agree with what you say. Yes, backlogged victims need some justice at this moment, otherwise there it is morally not good for everyone.
1. Why don't we petition first before thinking of Lawsuit. We from IV should write a letter to USCIS stating the injustice brought to the backlogged victims and how it is mentally affecting them etc. We should ask USCIS to consider these things and come up with a solution for backlogged victims instead of threatening DOS and others with Lawsuit. Since we are at their mercy, there is nothing wrong in keeping them higher up and at the same time getting what we want.

Thanks for writing. Supposing everything goes smoothly, what is on average the time frame to get to the stage where you get a PD. I'm not looking for miracles to get GC through nobel prize or gold medal. Just trying to have an idea here. Take it easy on a the poor man bro :)

I finally got the letters and the root cause of my I485 denial. My previous employer informed that they used my approved I140 for another employee. As many of you might know this I140 substitution practice was a loophole until June 2007. These days companies can not do this any more.
So probably when my I485 came up for adjudication, there was no I140 since it had been used and hence they denied it. Now, I changed jobs per AC21 rules--yeah the famous rule that USCIS ignores. I am waiting on my current attorneys to file an MTR as soon as possible.
Question to forum members:
1. Are there folks in EXACTLY similar situation?
2. If yes, after filing MTR and it getting accepted, what are next steps since one definitely needs a approved I140?
3. Further to #2 above, does one need to file another I140 and port the previous date? I am sure this would take longer time than the current H1b that I hold until June 2009.
4. Can any one share lawyer name and contact info who might have favorably helped a forum member so that I can contact the person and get a second opinion to discuss legal strategies that might be available.

I have a very close friend in Michigan, and asked him to join, but he talks about all hardships, about his HR manager, about his company, about his lawyer, about everything except IV stuff. I am sure there are many more people here doing the same thing. We have to motivate folks to come forward. We cannot afford to have people who are inactive.

I guess I am little late on this post but I thought I would share what I got from the USCIS Call Center.
My application reached on July 2nd. When I asked the representative about the fate of my application, first she said I should be fine. Then, I asked about the updated July VB and she put me on hold for 2-3 mins. She came back and told me that my application would be rejected and sent back in 15 days. When I told her that my application was received before DOS released the update and technically my application was received by USCIS when the bulletin was still current, she said that would depend on the descretion of that USCIS office.....funny but that's what she said. Again, she said that I could reapply in Oct and they will process the application then. But when I asked whether she was sure that VB will be current in Oct, she said USCIS doesn't know that.
So, the bottom line is.....there is no point in calling USCIS and asking them about the current fiasco as they themselves are unsure. You can still call them and you might hear something different but equally confusing.
Just everybody call them and post the USCIS CSR crazzzy answers. ...Atleast in future they will be careful not doing these kind of flip-flop things ........ We all know they will either reject or accepted and that decision needs to be taken at the highest level of USCIS...

It happened because of relentless canvasing of the media until the story got out and embarrassed the government. "Supporting the troops" is a no-brainer for a politician wanting to score political points. Most Americans could care less about immigrants or other citizens who are married to them. So there is no political urgency to solve that "problem." Although the media has reported that the exclusion of legal immigrants was "unintended," my sources say that the exclusion was intentional.
I had hoped to embarrass the government further by exposing the connection to a known "hate group," but the media has refused to report that part of the story. If I could get the media to expose the racist origins of this law, we might have some hope, but don't count on it.
The next phase is to focus on legal options.

I hear some people saying childish things like hijacking this thread if anybody says anything different from what they say. What do you prefer, should I open another thread with title "oppose prefiling AOS", nobody wins neither will I or you when somebody does that. Please tolerate others views then they will tolerate yours.
Without strengthening AC21 if you allow everyone to file AOS then anti eb folks like Grassley, Sanders, Sessions, Durbin will move from targeting H1b to targeting EAD. It takes 6 months to get Perm approval, with pre filing AOS everyone can get EAD in 6 months, anti eb folks and USCIS know that people will be jumping to EAD to escape H1 crackdown, what do you think they will do, they will add amendments and Bills to put restrictions on hiring EAD just like they put restrictions on hiring H1b. We cannot make EAD into another H1b like hell.
Prefiling should be done to give relief to people who missed July fiasco only after
1. Remove\dilute same similar job requirement
2. Make sure EAD is extended without any rfe. USCIS will invent thousand things to issue rfe, EAD should be in a different league to h1 and it should not turn into another h1 where you are slapped with rfe left right and center. Example Pay stub rfe, ability to pay rfe, customer Purchase order RFE etc etc etc, Green card holders don’t have any problem working in these same jobs so why should EAD people face this nonsense (otherwise it is just like h1). Before people complain this will become like a green card, lets me answer in advance, if a person from ROW can get his green card within 12 months of coming to US, why cannot people from India\china who have worked in US for the last 5 to 10 years get the above mentioned relief on EAD. EAD should be superior to h1.the only restriction should be you should work in the same field, i.e. if your labor certification is for Software engineer, programmer analyst etc , then you work in a software related job and cannot become a greeter in walmart :-)

Safeguards have to be put in place for order of priority date otherwise USCIS will indulge in this lottery mode and excuse there behavior by claiming they did this to save visa wastage.

I guess irrespective of which loc u get services from, they are louzy people. I had terrible experience with them. They take their own time to do anything(all counted in months). If you dont keep checking what happened to ur petition, its highly likely that files went into some waste bin!
But this helps employers, as does slow emmigration processing.
Though we have number power, all of us are helpless when it comes to lawyers.

All,
Is LUD mandetory after finger printing? I applied for EAD for my wife and me on 5/21. Sent supporting docs and had LUD on 5/23. Went for finger printing on 6/10 but no LUD so far. I am concerned if the finger printing center sent the data to USCIS or not. Our EAD expired 7/30 so I am concerned.

2) The members we had never met before who boldly allowed me to video tape their introductions. And committed to being more 'Active'.
3) New member brought two items for the future garage sale. Now seeing that nobody else had acted upon that request, it will probably give him an impression that the next time something is asked of members, it is not to be taken seriously, right? sorry to go into the negative again.

If you want some good reasons why H4's should have work permit read this
All these years the United States of America denied work-permits to
dependant visa holders with one simple explanation "You are in USA
because Your Spouse is allowed to work here". But numerous surveys by
different social organizations has thrown light on the darker sides of
the life of dependant visa holders.
The dependant visa holder has to forgo his/her career growth in-order
to stay with the spouse. This causes a big gap in the career and
finding a suitable job in the home country becomes difficult when the
pricipal visa holder has to leave USA and return to the home country.
If the dependant visa holder's field of study or work is, one in which
getting a sponsorship from an employer is difficult, getting a
work-visa is almost impossible. He/she even loses his/her hard earned
skills in the respective fields due to the large gap in career. Even
though volunteering is possible, most of the volunteer jobs might not
utilize the persons skills.
Studying in the USA is good option but, being a single income family,
it will affect the financial satatus of the family if other members of
the family (children) are studying.
90 percent of dependant visa holders are women. Women being, more
susceptible to domestic violence by the partner, becomes even more
prone to violence due to her complete dependance on the Spouse. They
become prisoners in USA due to the spousal abuse and immigration
policies that give their husbands complete control over their lives.
The immigrant Women get protection under VAWA but non-immigrants are
not covered. Even if a law to let the non-immigrant battered women to
obtain work permit is introduced, It might not protect women whose
cases dismissed as non-critical. The abuser can furthur exert his
control over the victim and convince her that he has changed so that
the victim might not press charges against him. Thus the abuser gets
encouraged to continue violence.
Divorce is not an option because most non-immigrants come from third
world countries where a divorced women has to bear the social stigma of
divorce and will not be protected in her own home country.
Because of the long queues for Labor certification applicationa and
retrogression of visa numbers, getting an EAD and Green Card takes
longer.
Most European countries issue work permits to the spouses. Also the
time taken for permanent residency is lesser. In USA L2 and E2 visa
holders can have work permit, but the other categories are ignored.
Fear of flooding the labor market is not a valid reason to deny the
dependant visa holders work permit. Allowing the L2 and E2 category to
work didn't create any marked increase in the unemployment rate among
US Citizens.

I guess irrespective of which loc u get services from, they are louzy people. I had terrible experience with them. They take their own time to do anything(all counted in months). If you dont keep checking what happened to ur petition, its highly likely that files went into some waste bin!
But this helps employers, as does slow emmigration processing.

BTW Paul hastings has been RESEARCHING for PD substition for me for last 3-4 months. So it looks all lawfirms are as good as another!

Sorry, you totally got me wrong. What I suggested is that you may want to open a thread 'Campaign to remove the similar/same job requirements in AC21 cases', it can happen at the same time we request pre-application of AOS. This thread is for discussion of pre-application of AOS, so if this is not your goal, you may open a thread for your own goals, but please leave this thread to us to discuss the pre-application of AOS.

I hear some people saying childish things like hijacking this thread if anybody says anything different from what they say. What do you prefer, should I open another thread with title "oppose prefiling AOS", nobody wins neither will I or you when somebody does that. Please tolerate others views then they will tolerate yours.
Without strengthening AC21 if you allow everyone to file AOS then anti eb folks like Grassley, Sanders, Sessions, Durbin will move from targeting H1b to targeting EAD. It takes 6 months to get Perm approval, with pre filing AOS everyone can get EAD in 6 months, anti eb folks and USCIS know that people will be jumping to EAD to escape H1 crackdown, what do you think they will do, they will add amendments and Bills to put restrictions on hiring EAD just like they put restrictions on hiring H1b. We cannot make EAD into another H1b like hell.
Prefiling should be done to give relief to people who missed July fiasco only after
1. Remove\dilute same similar job requirement
2. Make sure EAD is extended without any rfe. USCIS will invent thousand things to issue rfe, EAD should be in a different league to h1 and it should not turn into another h1 where you are slapped with rfe left right and center. Example Pay stub rfe, ability to pay rfe, customer Purchase order RFE etc etc etc, Green card holders don�t have any problem working in these same jobs so why should EAD people face this nonsense (otherwise it is just like h1). Before people complain this will become like a green card, lets me answer in advance, if a person from ROW can get his green card within 12 months of coming to US, why cannot people from India\china who have worked in US for the last 5 to 10 years get the above mentioned relief on EAD. EAD should be superior to h1.the only restriction should be you should work in the same field, i.e. if your labor certification is for Software engineer, programmer analyst etc , then you work in a software related job and cannot become a greeter in walmart :-)
