As mentioned by some others in the same thread: a lot of employers are also taking advantage of this situation.
i was one of those who was forced to file EB3 despite qualifying very well for EB2. The pretext is job description, although same job description has personnel applied for in EB2.
Quite a few of the EB3 crowd has had no choice, but to be herded in the slowest category to benefit the employer.
How can we highlight this?

I dont think this bill has or will have any favorable provisions for us unless a miracle occurs.
I think the tech companies have cut a deal with the Senators through which they will have access to 115,000 H1Bs and more moving forward inlieu of no increase in EB green cards.

Include Sep approvals as well, they can’t use all the visas in the month of Aug it self, it never happened before (in fact they wasted thousands of visas by the end of the fiscal each year in the past). This is the first time they have determined (?) to use all the visas, don’t expect 100% success in the first attempt it self. The system has not been fine tuned yet to that level of success.
For Sep, the EB2 dates will remain same or might even move further few months. Oct bulletin will be the interesting one. If there are very little approvals during Aug & Sep, it will move back considerably. If there are so many approvals in the tune of 15-20k, then EB2 PD will go back slightly (say Jan 06) but will move forward at healthy rate. Come last quarter of 2008-09, there will be quantum leap again.

Its a terrible tragedy when lives are lost. My heart goes out to the innocent victims and their family and friends.
Air France is conveniently blaming it on bad weather but I don't buy it...planes fly just fine in bad weather...at least well maintained planes. While their incompetency at customer service clearly shows, they are probably sub standard in maintenance and safety issues as well. Too bad innocent lives have to pay a price to bring that out.

Come on, man. We are paying too much attention here. Look, there is always somebody stuck somewhere. People are stuck in BEC, in other contries. People are stuck in Afganistan, Bangalore, there are hungry people stuck in Africa. So? If there are hungry people, then I can't enjoy my dinner then? I'm a June filer, and this July thing will hit me too, but I still congratulate those July filers. So what? I understand that we will start getting our EADs in a year (so we would be applying for next EAD once we got current one). I understand that USCIS officers will be irritated and pissed, they will be under tons of application and everybody will be calling and bugging them. So? I realize that it maybe will take 3-4 years for us to get GC. So? I realize that DOS might retrogress now dates for many years on Oct, and will not do the same stupid mistake as making dates current and unleashing the voluntary slaves. So?

Go_guy when did you come to US, When did you go to Canada (Toronto).Which job are you doing now in Toronto?
I first came in 1999 Fall as MS student. Then in between, I went back to India during the 2002 downturn and then came back in 2005. I did my MBA finance at U of T and now
working as Analyst since my second year ( due to F1 visa restrictions I couldn't have
done that in US). After graduation I am working there but looking for better options as well.
I came as PR in Canada. But i look at the international students from India in U of T. They are far better of than the international students in US. Here they get 3 years work permit
after graduation and can also work part time while studying. With new rules u get PR quickly after 1st year. Also during the 3 year post degree now they are eligible for the government health care like PR/Citizens. Canadian immigration is now highly tailored toward people
studying/working in Canada.
Compared to that, US treats its international students like dogs. If I get the opportunity to relive, one thing that I would not have taken was doing my previous MS in US. Moving to Canada was the smartest decision taken...no regrets.

I am not sure if it is only me.....but many times I see strangers wishing me or each other morning, evening...."how u doing" ,,,etc....
but Indians (I am also an Indian -:) are a little reserved....I do not see a greeting from fellow Indians that easily.....again I am not saying Indians are bad (cause I too am one -;)
maybe it is a culture thing for us not to greet strangers ?
PS - I have had my share of experience where non-Indians are also sometime rude me to me .....

The "Opportunity" usage has been explained much beyond Hiring in the other laws and related documents. Hence, an employee who subsequently faces discrimination because he/she cannot progress or misses on job advancements due to Visa limit restrictions is certainly being discriminated against.
Its my view and others can differ. I respect all opinions and am thankful to all because it helps improve my reasoning, mutual respect and tolerance abilities.

Regarding your answer for question 3 - when you say "renewal" what does it mean? There is just one application form for I-131, so should I simply fill out the same form regardless of whether the previous AP is current or expired?

Hi, we recently applied for COS to H-1B at California Service Center on May 26th under premium processing. So far we have not received even the receipt notice, neither have the checks been cashed. Just wanted to check with everyone if this is normal, or did they misplace the petition?

First of all I would like to Applaud the Consulate General of India - Houston for the phenomenal speedy service I received for my daughters PIO application via mail. I sent my application on Oct 1st 2010 and it's Oct 15th - we have already received her PIO along with our passports back!! All the information about delays which I had read online before submission seem to be rubbish.
Additional info: notarizing passports was hassle coz no one was ready to stamp the photocopy. Texan credit union manager made a letter with my passport information, took my signature and notarized it for free. I just attached the photocopies with her letter.
I sent the below mentioned documents from Dallas via $20 Express Mail USPS - with signature proof. Was delivered under 24 hours. CGI Houston returned our stuff in FEDEX.
For status update: I called the consulate 7 days after the delivery notification - (yes its tough getting through - but they do pick up the phone) the lady informed me the PIO card had been processed and will be sent soon.. Didn't realize it would be in next 3 - 4 days!

Based on the various discussions in this forum, the number is expected to be around 20k. No concrete evidence for this claim.
It will be interesting to see Sep bulletin. Because at present except EB2 I & C all other categories are either C or U. So, each and every visa will go to EB2 I & C and there will be plethora of approvals beginning Aug 1st. I-485 processing date is in July ’07 (both at TSC and NSC) and all the pending EB2 (till June 1st 06) may not be ready to adjudicated (RFE, denials, I-140 not cleared etc). If the above numbers are correct and given the fact that additional numbers will be available beginning Oct (2008 quota), there is bright chance that EB2 dates may still move further. This is my personal opinion.

This discussion is very valuble for people like me deciding between living in Canada as PR vs H1B USA .We all know that salaries in USA are slightly better than Canada .But now the exchange rate is almost equal.
Salary:
Can a person with family(2 kids) survive in Canada with CAD 50,000 / year salary in a place like Toronto.? I heard in Canada you pay 13 % tax on anything you buy .Does 50 % of your income goes in taxes ?
HealthCare:
Also is the government sponsored health care good compared to USA .I mean do you have any wait to see specialists.Is healthcare comparable to USA .
Immigration:
In USA anyone can get a Greencard regardless of their qualifications and it depends how early you enter the GC queue.But looks like in Canada they value your educations and other qualifications.Can IT professionals (non-managers) apply for Canada PR without a job or canadian education?
Canadian Citizenship:
Many people want to get Canadian citizenship and return to USA with TN Visa .In future ,could USA put restrictions on this .?

I like this and rallies at state capitals, because it would be easy for everyone to attend in their home states, but there might be small numbers in many cities that would not bring much attention
I also like letters, flowers, etc in mass
And also, how about:
The broken system is causing a reverse brain rain, right? Well How about we:
1- Each one of us buys 10 bath tub stoppers (you know, the stoppers you use when taking a bath, to stop the water gig down the drain) and mail them to Congress, Media, USCIS, etc- With a letter "Please stop the self-inflicted U.S. Reverse Brain Drain, already 100,000 highly-skilled have left, stop the 10-year green card delays for LEGAL highly-skilled immigrants"
2-At the same time, we ALL send WHITE roses to Congress (Roses are now IV's trademark, we are known for them and the peace they mean, and roses should probably be on IV's logo too) Attach same note
THAT will send a strong message!!! (trust me)

our prime minister wants us to come back to India. So his daughter may not be a good candidate for our GC issues.
Don't get me wrong, as the prime minister, he is interested in India progressing and using our talent for that purpose, not the US taking advantage of us.
He should ask his daughter to return to India first...practice what you preach.
