I feel that USCIS Workers/Contractors might be working all through this weekend to Approve as many EAD's as possible. I really wish they work the same way in approving AOS Applications.But Never... Punish the immigrants as much as possible, thats the Motto.

Here my 2 cents. Whether EB3 will move forward or not if you are in EB3 you are not in a position to chose. You have only two choices either be in USA or leave. If you decide to stay there is not harm promoting for these new immigration legislations. Even though it may have slightest chance, you have nothing to loose supporting it and working for it. In case it succeeds, you will get your green card much faster than normal process.

1.3M backlogged cases TOTAL (includes naturalization), out of which more than 800K are retrogresed family-based AOS petitions, and what looks like 30K EB petitions (cannot be approved due to statutory limits). 300K cases in namecheck, maybe 10% of them are EB (EB is about 13% of green cards), so we are having about 60K truly backloged EB cases in March 2007.
We know that cases that are current and not stuck in FBI checks are being approved farily fast, so my gut feeling is they have maybe 50-80K EB cases in active adjudication. Let's double-check -- out of 1.2 million cases ready for action, about a half is naturalization, and from the other half, ~13% would be EB - yep, 80K (EBs are the easiest to approve because there are no interviews or tests, so the percentage is likely less than 13%).
So, in March 2007 there were a total of no more than 140K pending cases in I-485 stage of stocessing. Now in June-August EVERYONE who had an approved LC got to apply, and there were ~300K applications, while CIS gave out ~70K green cards, so we would have a total of 370K pending petitions. This estimate is surprisingly close to 13% of the total 2.5M backlog, so I would consider it good.
Again, I absolutely do not believe there are more than 500K EB1-EB3 cases. There may be another 500K in the 'other worker' category, but this is not what we are talking about here.
We can argue who is right on the numbers for a long time, The Ombudsman, who quote that they can not say for sure what the numbers are, or the kauffman Report who claim 1.1 million. Even if we go with your number of "no more than 500K" - thats a 3 year wait if there are no more country caps.
Also from the Ombudsman:-
"In FY 06, over 10,000 employment-based visas were lost, even though USCIS had an estimated 100,000 to 150,000 pending applications for employment-based green cards." - Pending applications for employment-based green cards means "application approved pending visa number availability" - ie all but approved - waiting for a visa number, not all 485 applications.
"As of May 2007, USCIS reported a staggering 329,160 FBI name check cases pending"
I'm obviously not adding those numbers together, but I really believe that the numbers are larger than we think.
Remember to take out the visa's unsued each year (per the ombudsman, in the last 3 years, thats only 100k wasted) that brings down the number of visas available, and remember there are other visa paths into greencard application, not just H1B.
They also think there are roughly about 170K at BEC... that haven't hit yet. Add that to the number - all with old PD so you better believe their dates will come current sooner.
If you've read the Ombudsman's report, you should have figured out that things are NOT moving quickly
I've just realized, are you looking at just 485 numbers and not everyone in the EB GC queue?
Finally - if you've read the Ombudsman report from the past few years, they will look very similar to this years' one (although they gradually get more and more bleak). Nothing has change to make the situation better, so the expectation that all of a sudden things will get fast now still baffles me.

How many people in EB2 do a different job from EB3?
Most of the people in EB2 almost do the same programmer job. I have been in this country for a long time. I have friends who have done their MS from colleges like stanford, santa barbara. I don't see a difference in their role. I have more than 10 yrs of exp. I have worked in different roles too.
For jerks like u to come and talk abt people in EB3 being unskilled, makes me sick.

In any case the classification is not based on one's country of origin or individual's personal qualifications ... it is based on what the job requires. heck an individual having Phd can get a job which requires only 2 yrs study and no exp that doesnt mean that they are any less qualified that a person in EB1 for any country .... but the most value gained is in the EB1 category job....hence the argument.... nothing to do with where you are born or what individual qualifications you possess .... Im sure you are highly qualified and educated ... think and read ...

Hi,
My H1B 6 years will be finished in February. My I140/485 were filed in August and I will be laid off on December 31. What options do I have now?
- My employer had filed my immigration papers at my current work location. They are willing to relocate me to different location but are not sure on the impact of change in address. Can I relocate with my current 140/485 filed for current address?
- Can my H1 be extended based on approved labor? I can then move to new location with same employer on renewed H1B and start the entire process again?

The bottom line is that opinion letter is written by a USCIS officer and that I was referring it. And most important of all, you were proven wrong, again. That is the real reason of you being upset.

I was reading the posts, I somehow believe there are some variations among EB2 categories, of what we all have been calling I,II or three.
It is not not primarily based on salary only, I believe, it has more to do with the nature of your job, job title, size of the company, type of company, for profit or non-profit.
My wife is a University professor, applied for our GC, EB2 India PD date august2007. We got our labor approved in a less that 2 months, we got our I40 cleared in 5 months, ( applied in January 08 got approved in June).
I believe , we are able to move so fast in this process was mainly because the type of company she works for, in this case the non profit institution.
Now at this point in time, I would like to ask all the gurus, are the dates going to move fast in next few months?

I think if USCIS start publishing the number of applications (based on PD of course) pending for each month, then we can predict our future and life will be much easier.
We are not asking for too much and I think IV can make it happen fairly easily.

I know everyone wants to get out of this state called as "PROBATIONARY LIMBO". The real solution is to eradicate retrogression and at the earliest. For this to happen, we need some legislation in our favor.

That is right. But same country quota is there in EB system also. So in point system also 80% of people will get same quality of people as current system. But advantage is process delay will be eliminated.
I think people should read the legislation completely and understand before they comment on the proposed system.
With the existing system people will wait for their turn , In the proposed new system the application gets trashed and one cannot apply for 3 more years if one can not make it in the year he or she applied.
What are the rules governing the new system when more people get highest score than the available green cards per country . It would be another lottery . This can not be a merit based system unless they remove country caps.

Just a quick update I efiled on Sept 22nd 2009. Was assigned to LIN, Nebraska. Sent supporting documents the next day by first class mail. Received 2 copies of advance parole in the mail yesterday. Checked online this morning case was approved on October 2nd 2009. So basically from filing online to approval took 10 days total. I am amazed.
