Thats good news. Hope it works. My feeling is that EB category will have more support in the Senate if they dont overdo the helpful provisions (read cap exempt etc..).
What is good about it. How will this decrease our current backlogs. This is an amendment to change the merit based system, not solve the current backlog problem.
We cannot judge at this point in time what the final bill is going to be like.
If the merit based system after passage of the bill seem more lucrative then many will re apply under this system and we come back to square one - i.e backlogs
We have to get out of the current problem which will solve a lot of problems.

I was 100% determined in the beginning to attend the rally, but could not for the following reasons.
1> I was in Dallas and family in SoCal for last 9 months(from Dec 2006 to be precise). I used to meet my family every other weekend. Was trying very hard to find a project in Socal, and finally I got one where joining date was Spet 13th. I could not dare to ask for leave in the very first week. To tell you the truth it took so long b'cos of H1 status, everybody wants me to transfer my H1 or they are looking only for GC/EAD holders. Hoping to get EAD soon.
2> My husband was planning to attend but somewhere in Aug last week we got FP notices and date is Sept 18th. The FP letter clearly mentioned that postponing might cause delays so we decided that he also has to drop the idea.
Of course we contributed towards the rally.
I am very proud to be part of such excellent grass root organization and now since I am in Irvine I can be active in Socal chapter.
Also we are eager to join in the next rally and have total faith in IV leadership.

I agree with you. Why are we penalised for being on H4 Visa ?
Most people on H4 Visas are well educated and would easily be able to contribute to american economy. We are lawabiding and can give so much to american economy. All our talents are wasted and skills are rotting sitting around for the backlog centers to clear the LC's and for retrogression to end.Meanwhile we practically have no life and are completely dependant .
Immigration Voice should try to include the greviances of H4 spuses into consideration.

Some of the core members are also stuck in BEC. But they still worked selfleshly. And don't preach injustice to me, I came here to study in 1999, got one labor (PD 2002) rejected on technical grounds, went in for other labor PD 2005, so my situation is probably worse than you.
Most people showing their cool wisdom still not getting the point. A BEC person with Feb 2005 PD may not be able to file for another 2 years while a PD 2007 person will be enjoying EAD during that time. In my dictionary this is injustice. And that's why i was kinda happy when they updated the July bulletin, now I'm not really happy even if my company has already filed my 485/EAD on july 2. I'm still wishing (and i'll be honest) USCIS come up with a reason/regulation/rule that will delay EAD for everyone until BEC people are able to file 485 OR in Oct they retrogress only till March 2005.
P.S. if you are superstitious, you want to know this: most of my relatives/freinds call me "Black Tongue" because usually when i say something unpleasent it happens. e.g. i told my wife last month that i don't believe everyone is able to file 485, something will go wrong and everyone will be disappointed. (when everyone expects something it does not happen- contrarian theory)

The problem here is not 5000 dollars. The problem here is that the situation is hopeless because they dont assign country of chargeability to pending 485 cases up until they are ready to approve them, if I read it correctly. The data that is not captured is the data that cannot be queried, simple as that.

So how do they say they have a project manager and this project manager is now accurate in moving dates so there wont be any more back and forth date moment but a steady moment? Is there some kind of guess work based on different data collected?

so far, Senate Majority Harry Reid alsked the republicans to "stop" these things.. but we know they managed last year - so, if we don't do something, we may end up not receiving rebates this year also.. especially given the fact that Obama is trying to get support for this to pass in senate and not one republican voted for it in house...

if i was an EB-3 applicant (thats AFTER EB-2 and AFTER EB-1) i would be careful about who i call stupid and educationally unqualified.....chill big guy....:)
if you read my post carefully (and if you can understand it) u'll notice that i called the "idea" stupid not the person. Filing in EB3 or EB1 does not prove your IQ.

This is a very common problem. They are not following their own rules when it comes to 180 day rule of I-140 revocation. And I have heard AC21 letter almost never reaches your file. But because you have filed AC21 , you are in good shape. You have all the proof that you did send the AC21 letter and I-140 was revoked after 180 days.
So you will be able to open this case using MTR. Do not worry , you just need good lawyer to represent you.

First decide whether we are FOR CIR or NOT.
Looks like a lot of people have doubt on this basic question.
The answer is not simple because of the various stages many people are in.
In fact for me CIR in its current state is better. However, for a person who has not cleared the labor, cir will not be favorable, as he/she has to reapply.
In my humble opinion we should just ask for one or two minor things, and this "comprehensive" approach of we are the "pork" in the bill is flawed.
We should at the most ask for the basics. "recapture of past visas", and ability to file I-485 immediately. Highlight that this is only a matter of interpretation by uscis and no major law change. These two points itself will have IMMENSE benefit for us.
Any change that is drastic like removal of visa cap for STEM etc, most likely will forever remain a dream.
I can tell your case. If you apply now by EB you will get gc within 3 to 7 years time. If you apply by point system after 5 years of USA experience and you will have employer sponsor you will have 16 points more than those who are coming fresh to USA. So both point system and EB system you will get at the same time period. Process delay will be minimal as no labor or I140.

I hate to say this and I hope I am wrong. All of us EB3 folks need to start speaking up or else our fate is sealed. I do not see any hopes of CIR passing. There is always going to be some political backlash due to the AMNESTY factor.
From what I have seen, most employers are now filing only in EB2 category. They know that filing in EB3 will see their applicants backlogged so severly that there is no hope in seeing their applications approved. So, even those with less than 5 years of experience create resumes that show 5 years to qualify for EB2. Imagine the flood of applicants in EB2 that will pour in when the dates move forward beyond July 2007. There will be a new backlog of EB2 numbers that we have to wait behind. When are we going to get our turn?
With nearly 10 years of experience and a master's degree, I am still languishing behind all these new comers who come here with fake experiences to qualify for EB2.
We EB3 folks need to speak up, and have the spill over given to the oldest filed applications IRRESPECTIVE of category. The spillover rules from what I know were defined at a later stage and not as per the original law. If we cannot get CIR passed nor a piecemeal regulation, at least let us get the spillover changed.
Or, let us en masse transfer to EB2 by porting, thereby making us all eligible for GC ahead of those that are coming in through the back door. I see them as no different from the undocumented immigrants. Breaking the ethical law at the expense of those of us who followed the law. Our positions did not require a Master's degree and I dont see why a programming position today still requires such. I also dont see why our experience today should not count towards qualifying for EB2.
I dont care what or how many reds the EB2 folks give, but the fact of the matter is that we EB3 must join hands.

I got an email from my law firm, that my packet was refused to be accepted by USCIS.
I received the email from my law firm (Monday night - July 2) that:
Please note however your case was sent to Nebraska last night and did arrive - we tried!
Which means mine was sent or reached NSC sunday night or must have been hand delievered early Mon morning. Don't know exactly what happened. I just trust them!!!!
I didn't bother to ask my law firm further details. I will ping them first thing monday morning and try to give any update I get. I hope they have some proof of the refusal!!!!!!!............
OK, that sounds VERY FISHY to me. Now how on earth did they know that the packet contained an I-485 application in order to refuse accepting it. It could have been an I-140. The norm we have seen up to now is that USCIS did accept everything that was delivered on the 2nd. Wheather they will keep it or return it is another matter.
Now it seems to me that your attorney is playing with you. Quite possibly he didn't send it.
