This presumably covers the many cases filed after the second that were held, but it doesn�t explain what will happen to the cases received earlier. We hope USCIS will issue special instructions to issue July 2nd receipt dates to those who are able to document they attempted to file. We presume some folks are still waiting on their July 2nd cases to be returned and are debating refiling new cases rather than waiting. Unfortunately, there is a risk of not getting the package back before August 17th and some people will need to refile without proof of the earlier filing. Hopefully, again, USCIS will institute a process for such individuals to avoid being penalized.

Just asking out of curiosity because when an illegal alien lives and possibly runs from cops from place to place for a period of time then they are qualifed for a green card and eventually citizenship.
Why would they become nice to them after a certain period of time? It is illegal.

Hi,
I have received notice for I-485 FP, but my I-140 is still in process (not approved or anything). How is this possible? Is it because of concurrent filing?

yes, its normal and ok. Your 485 will be processed independently of your I-140, and your fingerprinting, namecheck etc will all keep happening. You just cant get it approved without getting the I-140 approved first. Everything else goes on in parallel.

I have a question about filling out this section: PART 4, Processing Information. I am the employer and applying for a current H-1B holder (currently with another company) to transfer to my company AND extend his stay. He is currently here in the US.
Some people tell me I don't have to fill this section in, however the instructions say "if beneficiary...is outside the usa OR a requested extension of stay...cannot be granted, state US consulate or inspection facility you want notified".
What address should I put/consulate should I use (H-1B holder is from India).
Questions: 1) do i have to fill in all 1.a,b, c, and d?
2) does it matter if i check off consulate, pre-flight inspection, or port of entry?
3) if beneficiary doesn't have a fixed address in India anymore can I leave it blank?

2. EB2 PD-May 2000 Project Manager/Senior Architect/Team Lead Degree: Masters in CS prior to 2K
American co., no need to pay for labor. Should come with a project with a corp to corp option. Co. has clients but it may take time as July 16th is last date.

Hi,
I got a RFE while doing my H1B transfer under premium processing. They have stated to respond within 60 days. Does anybody have an idea as to whether it takes so long or it gets resolved soon under premium processing? Please help.
Once they recieve the response, if they are satisfied, the same day they will approve. It will not take that long depending on the type of RFE.

My I-140 on EB3 category is under appeal and decision may come in Aug 2011. I applied for Labor in EB2 category in Nov.2010 but it went for audit. This audit decision might come after 20 months. If my I-140 of EB3 is denied then can I extend my H1B status based on pending Labor Audit. My current H1B is valid till Feb 2012.
Please advice.

Company A filed for GC. Labor and I-140 was approved. I-485 was filed during July 2007.
I changed employer in June 2009; replied to RFE and filed AC21 in July 2009.
I came to know that my GC sponsring company is going to close the company soon. My current immigration attorney is suggesting that if that happens; and if INS came to know that GC sponsring company is closing down, they will revoke my I-140.
Is it true? I thought after AC21 is invoked; whatever happens to GC sponsring company, it will not impact my GC application in any way.
Please advice.
