Anti-Immigrants are spreading their message on prime time TV.
I was watching CNN and all of a sudden there was this ad by http://www.american***ker.org( I dont want to advt for them):mad:
May be this msg is old, but I saw this for the first time today and it left a bad taste in my mouth.
What was sad about the whole thing was that the message was so misleading that even the average Joe out there would blindly believe this msg. The antis clearly hid the facts and rode heavily on the unemployment wagon, eventually blaming foreign workers for all their misery.
Oh God save legal immigrants!!!

I have a approved I-360 (Batter Spouse Petition) and a pending I-485. However I got a letter in the mail stating the will revoke my 1-360 based on Section 204(a)(1) of the Immigration and nationality Act! It further states that I am not a person of Good Moral Character.
I was arrested in Belize my home country on November 19 2002 for Harm.Which would be Assault, and charged $100.00 and released.
This was not include in my initial application becausse it was outside the 3year period since my application was in 2007.
So I got the court documents and I am ready to submit it! but I am not sure if I shoudl seek legal advise or just submit the required document that they want!
They are asking for:
1.) Arrest Report.
2.)Copies of Cout documnet showing final disposition.
3.) relevan excerpts of the law for that jurisdiction showing Maximum possible penalty for each charge.
Please advise! is this something I should be feareful of?

Hello Everyone,
Iam an H4 transferred to H1B. I am on H1B since one year. My pay is less than the one mentioned in LCA, but more than the prevailing wages. My job profile also includes some part of salary as comission, which I would get at the end of the year. This is apart from the salary Iam receiving right now (greater than the prevailing wage and less than LCA). Do I face any problem if I happen to go for H1B visa stamp. Could you also suggest me how to defend myself if I am asked the difference in the salary by visa officer. Thanking you all in advance.

Could someone tell me please.....I'm filling the application for advance parole the first time......what should I write where it is written: " Date of intended departure"...if I dont know exactly when I'm leaving....should I write a date or should I write " I dont know yet?"
And also I read that the documents required are 2 photos, I-485 receipt notice, I-140 approval notice.....is that right? or what other documents do I need?

Hello,
I am completing 4 yrs of my H1 and currenty working with company. I already have my PERM & 140 cleared through this company (EB3).
Hence, if I continue with this company, I do not have to worry about 6yrs limit on my H1.
However, if I have to change my employer:
1. Now?
2. After completion of 6 yrs (i.e. H1 extensions) would I be able to do that?
Also, what will happen with my GC? Will that be fresh start from scratch?

Most of the shots given are booster shots. Two MMR shots?
Varicella needs to be taken twice at 1 month intervals, however most doctors sign and seal the package when you take the first varicella shot and then ask you to come back one month later and take the 2nd shot, if not, you can insist the doctor to do so.
Needed shots are MMR, TD and Varicella, all others are Age unappropriate for us(atleast the applicants and spouses).

I was on H1 with my previous company but laid off last week. I have !485 AOS and EAD.
I believe I can straight away join any company (consultancy or any enterprise company) on EAD , right pls ?
if get a job offer from Comapny "A" and join them today and file AC-21 today and meanwhile say I get another job from another Company "B" after two days and join them, can I file another AC-21 without waiting to hear back from USCIS. I believe AC 21 is just informational for USCIS that I have switched the jobs.

I can just work 20 hours a week . Is that permissible to be on EAD and still get GC processed?

I e-filed my EAD renewal application along with my wife's EAD application on 03/16 and both were approved on 04/07. We both have sequential receipt #s.
However, we received my wife's EAD on 04/12 but not mine. I am the primary application of 485.
Does this happen often ?

Theoretically, it's possible. However, if there is a Ability 2 Pay issue during 485 adjudication, would you be able to take care of it?

My daughter (5 yrs) is an US citizen and having passport valid until end of Sep 2009 and having POI card for 15 years from Indian consulate.
Now I am planning to take her to India for 3 weeks from Aug 1st week. The travel agents says her passport should have at least 6 months valid from the date of date of the return (Aug 4th week). Is that true/correct? Can she enter here in USA after her India visit with 20 days left in the passport validity?
I will be using my AP though I maintain H1B status (I-797) and work for the same employer.

Hi Experts,
Would appreciate your help here. My sister is studying on H4 visa and her husband applied for I-140 in EB1 but it got rejected and now they have filed appeal for the same. He has his I-140 approved for NIW already though. Currently, My sister wants to move from H4 to F1 Visa as NIW case will take a lot of time and EB1 case has less chance of getting approved. Is there any problem in doing so ? Will having approved I-140 for NIW or pending appeal case affect her F1 application ?

My Wife had her COS from H4-H1, and I filed my I-485 in July with my wife as secondary applicant and already got our EAD,AP. We are planning to Visit India this month and my wife wants to use her AP while travelling back to US.
1. Is it advisable or are there any issues with using AP.
2. Can she use AP that she received as a secondary applicant and continue to work on H1B with her current employer
3. In Case her Status changes to EAD, can we reinstate her H1B at any point in time without counted against H1B Cap.
