Hi,
MY 485 LUD first happend on the day we went for FP on Oct 24.
On Nov 3 we saw one more LUD on 485.
We did not get EAD or AP yet..

Guys..
I am taking up a new job... The pay is good (10% more) and position is also of a senior lead developer.. I am not even leaving the area.. The company is 5 times bigger than my current one... I have an EAD card valid till Sept end 2008....What is your opinion. Should I go for the new offer? I am worried if anything will happen to my GC processing. Please help me make a decision.. Thanks as always...

Folks,
I have a break period of 4.5 months. May 15 - Oct 1st. I was wondering if its OK if I just take a course in fall or should I enroll for summer as well. My grace period will end Jul 15th but by that time I should have an I-20 with me for Fall. Is that fine?

Hi All,
My EB3 RIR is filed on Feb 2005. Waiting for LC to clear. Also H1B expires on Jun 2007. Waiting for H1B extension for another 1 year.
I would like to change my job once I get my H1B extension.
1) Can I change my Job during my one year H1B extension when my LC is not cleared?
2) Can I use my current PD (Feb 2005) when my new Company process LC again through EB2 PERM?
3) From the new company, once I get LC through EB2 PERM, can I apply H1B extension for 3 years?
Please advice. Waiting for you reply.

My PERM was filed in Dec, 2006 and was denied on April, 2007. As per my employer's lawyer it was erroneously denied by DOL. The lawer has received the denial letter but no reason was stated. He was keep on follwing up with DOL but no answers. On Aug 2007, lawyer was followed up again directly with the DOL office in Atlanta , with the liaison at the American Immigration Lawyer's Association and also it was sent to the congressional office. Through Senetor we came to know that there was typo in the date field. The lawer is persuing to get the denal letter again with reason so that we can appeal. But we have 10% chance to get the another deial letter. Now lawer is asking for filling a new PERM. In between I lost 8 months and now I'm running out time. My 6th year is expiring on Sept08. Just incase if we din't get denial letter and file the new PERM on Mrach can we get the 7th year extension ? (We will show all the documents etc for previos denail case and there was no reason in denail letter. PLEASE HELP

Hi All,
Can any one give me what is the usual time frame given to respond to an RFE for I 140. I have seen in various threads that it is usually 12 weeks.
On Feb 22nd, I got an RFE on my 140 and the letter reached attorney's office on Mar 6th. On the RFE letter, USCIS has asked to repsond by April 7th. That is hardly 6 weeks and 4 weeks from the data I recd the letter. Is this usual?

If we are on H1 and able to file I-485(AOS) and continue to be on H1 until it expires. Then are we automatically on AOS after the expiry of H1? Or do we have to inform USCIS our intent to switch to AOS?
The reason I am asking this question is: I saw a case, although not similar, where the individual was on H1 and applied I-485 (inJuly 2007), he continued on H1 until it expired and decided to stay on h1 and so his employer applied for extension of H1 in 2009. My I-485 is pending with EB3 Feb 2006 priority date. Invoked AC21 and currently working for a different employer. Have Masters degree and 9+ years of experience.
Is there a way to re-apply for Green Card under EB2 category thru a 3rd employer and retain the old EB3 priority date?

hello! i overstayed my visa by several years, left , and was able to get a new tourist visa and enter the u.s.
after leaving the u.s, on return,i was denied enterance, removed and banned for 5 years. my boyfriend lives in u.s, he's a citizen. is a fiance visa helpful to allow me in until we get married? is there even a chance? or do we need to marry outside of the u.s in this case? thank you!

My previous employer filed EB2 labor for me. I left the job after getting 140 approved so that I will hold the priority date.
The new employer, as per their policy is planning to file labor application in EB3 category and NOT in EB2 category.
My question is, the way I post PD from old approved 140, do I port the EB2 category also? ie will my PD get compared with EB2 PD or EB3 PD when it comes to filing 485?

The USCIS announced today, April 27, 2009, that it has received approxiamtely 45,000 H-1B petitions counting toward this fiscal year's general cap of 65,000. Therefore it will continue to accept H-1B petitions that are subject to the general cap.
Then USCIS also announced that it has received approximately 20,000 H-1B petitions for aliens with U.S. advanced degrees subject to the 20,000 advanced degree cap. However, the USCIS says it will continue to accept additional advanced degree petitions because it knows from past experience that some number of the advance degree petitions are not approvable for any number of possible reasons.
I will update this blog on the H-1B account as soon as the USCIS makes further announcements.
