Employment based I485 is pending and priority date is not current, and wont be current until we have cars that fly. Have valid advance parole from EB I485. Plan to file a family based I485 next month and wait for receipt notice and then travel out of country.
Is it possible to return to US on the advance parole from EB I485 after filing FB I485? (Application for a second advance parole based on for the FB I485 will be pending as it takes ~3 months to process AP).

As pappu stated in the first post of the above referenced thread - some of the ongoing efforts include finding how many IV members would get benefit from such a provision and get basic details such as username/Priority Date of impacted members. Future action items might include drafting documents and letters to support this provision. There maybe actions such as sending emails etc. However we would not be able to open a public action item unless we can have thousands of our members willing to participate in a grassroots action item. This survey intends to understand the needs of our membership for this provision and collect grassroots information.
The fact is we have a dedicated group of volunteers (and we need more) who have been trying their best to spread the message about this initiative so that a strong grass-roots support can be created leading up to launch of the public action items. So far we have around 1100 people who have responded. Based on quick calculations carried out using PERM data, it is estimated that there are at least 60K-70K EB applicants waiting to file I-485/EAD/AP (this is a very conservative estimate..the actual number could be much more). Grass-roots initiatives require time and patience and we request maximum number of impacted folks to participate actively.

Effective July 9, 2010, the Department of State revised its visa reciprocity schedule for China to allow for a 12 month, multiple entry visa for H visa applicants. This will allow H-1B visa holders from China to have multiple entries into the U.S. for a 12 month period. The Washington Post reports on data released from the Border Patrol. Among the findings: - The number of Border Patrol agents has more than doubled from 9,000 in 2001 to 20,000 this year - 626 miles of the border with Mexico are now covered by fencing and vehicle barriers which is about half of the planned coverage on the 2000 mile border. - Border arrests are down from nearly 1.75 million in 2000 to 723,000 over the past year While the economy obviously plays a role, the dramatic uptick in enforcement sure is playing a role and Senator Schumer's contention...

Hi
I came to US on L1 in 2005 thru COMPANY-A and then applied for H1B thru COMPANY-B in 2006 and got approval under 2007 CAP. But I didn't start working for COMPANY-B(H1B) and went to India after H1B approval but came to US on L1B again to continue my work with COMPANY-A(Did a leapfrog).
In 2009 I transferred my H1B from COMPANY-B to COMPANY-C and got the petition approval. So I have a valid H1B petition with COMPANY-C.
In the same year my COMPANY-A(L1B holder) applied for COS to H1B under new 2010 CAP and got approval. So my status has been changed from L1 to H1B with COMPANY-A.
Now I have 2 approved valid petitions, one with COMPANY-A and the other with COMPANY-C, my question is if I get an offer from COMPANY-C can I start working with them with out any H1 transfer application ?
or can I transfer my H1B from COMPANY-C to another COMPANY-D ?

I am on H1B extension. Means my stamp is expired.
I have a ticket to go to India. I am traveling through the following route
Boston- London- Bahrain - Bombay.
I heard that I need to have transit visa for UK as my connection is in UK (2 Hrs).
I don't have the UK visa and I will not have the US visa at the time of entry in UK.
I have very sort time now in my hand.
1. I really need to have the UK transit visa?

Conservatives Launch Caucus (http://www.rollcall.com/issues/53_52/news/20766-1.html) By John Stanton | ROLL CALL STAFF, October 31, 2007
Frustrated by what they see as a party gone astray, a group of House and Senate conservatives led by Sen. Jim DeMint (R-S.C.) and Rep. Jeb Hensarling (R-Texas) today will announce a new bicameral caucus aimed at returning fiscal restraint, ethics and national defense to the fore of the GOP's philosophical and policy platforms.
The group - which in addition to DeMint and Hensarling is made up of Sen. Tom Coburn (R-Okla.), Rep. John Shadegg (R-Ariz.), Rep. Paul Ryan (R-Wis.), Rep. Tom Price (R-Ga.) and Rep. John Campbell (R-Calif.) - will officially announce the creation of their new caucus - dubbed Reagan21. They also will unveil their "statement of policy commitment," which includes 10 key positions on issues ranging from Congressional earmarks to health care reform.
While participants are billing the new caucus as a complement to the leadership teams in place in the House and Senate, Republicans familiar with the project acknowledge that to a certain degree it is a challenge to Senate Minority Leader Mitch McConnell (R-Ky.) and House Minority Leader John Boehner (R-Ohio), because implicitly the call for a new direction is a rejection of the course they have steered along with President Bush.
"When you're saying, 'Here's the vision of what the party should be,' you're saying the vision isn't there right now," said a House Republican not directly involved with the effort.
A second Republican agreed, arguing that a more broad change in how the party runs is needed.
"Whenever there's a vacuum in elected or political leadership, there's a need to fill it. When you have leadership positions not resulting in leadership, people will go elsewhere," the second Republican said, adding the problems of the party go far beyond simple messaging conflicts.
"It's a fight for [the GOP's] soul, not just a superficial divide. There are people who believe it's the job of Republican Members to come here and send money home to their states and to expand government. And that's just not what rank-and-file party members want."
Today's announcement of the group's principles for reform of the Republican Party are the first in a series of steps that the caucus will take over the next several months. Members are in the process of setting up independent outside institutions - similar to the Congressional Black Caucus Foundation - to support their activities, and they will have a Web site up and running in the next few weeks.
Although details of those plans were unclear at press time Tuesday, one member of the group said the caucus will use the foundation as a semi-independent apparatus to communicate with Republicans outside Washington, D.C., as well as the general public.
Although members of the group declined to comment on the caucus on the record, one Member involved said the lawmakers believe the GOP's elected leaders have strayed from the party's traditional fiscal conservative roots.
"A few of us here are trying to change the culture" of the GOP, the lawmaker said, adding that "the core values of the Republican Party are not being adhered to by the party inside Congress. But there's a yearning for it outside the Beltway."
According to Republicans familiar with the effort, it arose from meetings between DeMint, who chairs the Republican Steering Committee in the Senate, and Hensarling, who chairs the Republican Study Committee in the House. Both organizations are the hub for conservative efforts in the chambers, and following the disastrous 2006 election, DeMint and Hensarling began holding meetings in an effort to better coordinate their efforts.
Eventually, the two began to bring other lawmakers into these Member-only meetings. Following months of discussion, the group decided to start the caucus, choosing a name that would invoke the core fiscal principles of former President Ronald Reagan for the 21st century.

According to GOP aides, the group has operated under strict confidentiality rules as it has hashed out how it will operate and what its mission should be - so much so that staff continue to have only a sketchy idea of what their bosses are envisioning. Additionally, the members of the group have agreed to not tip their hand to either Boehner or McConnell before today's news conference, although they have begun reaching out to like-minded Members in the House and Senate to join the group.
The formation of the caucus is the latest in a series of breaks between conservatives, particularly in the Senate, and the party's traditional power centers this year. DeMint and Coburn have openly and repeatedly attacked "Old Bulls" in the party like Sen. Ted Stevens (R-Alaska) for their use of earmarks. Additionally, conservatives openly broke with their leaders this spring over the immigration bill.
The Reagan21 member cautioned that the caucus's critique of current GOP positions should not be seen as members "tak[ing] a swipe at anybody" in leadership positions. "They've got a tough job and it's hard to get your arms around the whole party" in a way that could facilitate reform, the lawmaker explained, adding that Reagan21 participants see themselves as "the conscience of the Republican Party here" in Washington.
But reform will be key if Republicans are to avoid further electoral loses next year, this member said.
"Unless the Republicans get together and define themselves we're going to get caught in fog. ... I don't want to be Democrat-lite," the lawmaker said, adding that the group hopes to attract Members who have long been fiscal conservatives as well as new recruits. Reagan21 hopes "that a lot of these Republicans who like to think they can have it both ways - go home and talk like conservatives but come here and vote for whatever they want - will be forced to come to our side. We can't continue to allow a few people in our party continue to pervert what we are about."
Frustrated by what they see as a party gone astray, a group of House and Senate conservatives led by Sen. Jim DeMint (R-S.C.) and Rep. Jeb Hensarling (R-Texas) today will announce a new bicameral caucus aimed at returning fiscal restraint, ethics and national defense to the fore of the GOP's philosophical and policy platforms.
The group - which in addition to DeMint and Hensarling is made up of Sen. Tom Coburn (R-Okla.), Rep. John Shadegg (R-Ariz.), Rep. Paul Ryan (R-Wis.), Rep. Tom Price (R-Ga.) and Rep. John Campbell (R-Calif.) - will officially announce the creation of their new caucus - dubbed Reagan21. They also will unveil their "statement of policy commitment," which includes 10 key positions on issues ranging from Congressional earmarks to health care reform.
While participants are billing the new caucus as a complement to the leadership teams in place in the House and Senate, Republicans familiar with the project acknowledge that to a certain degree it is a challenge to Senate Minority Leader Mitch McConnell (R-Ky.) and House Minority Leader John Boehner (R-Ohio), because implicitly the call for a new direction is a rejection of the course they have steered along with President Bush.
"When you're saying, 'Here's the vision of what the party should be,' you're saying the vision isn't there right now," said a House Republican not directly involved with the effort.
A second Republican agreed, arguing that a more broad change in how the party runs is needed.
"Whenever there's a vacuum in elected or political leadership, there's a need to fill it. When you have leadership positions not resulting in leadership, people will go elsewhere," the second Republican said, adding the problems of the party go far beyond simple messaging conflicts.
"It's a fight for [the GOP's] soul, not just a superficial divide. There are people who believe it's the job of Republican Members to come here and send money home to their states and to expand government. And that's just not what rank-and-file party members want."
Today's announcement of the group's principles for reform of the Republican Party are the first in a series of steps that the caucus will take over the next several months. Members are in the process of setting up independent outside institutions - similar to the Congressional Black Caucus Foundation - to support their activities, and they will have a Web site up and running in the next few weeks.
Although details of those plans were unclear at press time Tuesday, one member of the group said the caucus will use the foundation as a semi-independent apparatus to communicate with Republicans outside Washington, D.C., as well as the general public.
Although members of the group declined to comment on the caucus on the record, one Member involved said the lawmakers believe the GOP's elected leaders have strayed from the party's traditional fiscal conservative roots.
"A few of us here are trying to change the culture" of the GOP, the lawmaker said, adding that "the core values of the Republican Party are not being adhered to by the party inside Congress. But there's a yearning for it outside the Beltway."
According to Republicans familiar with the effort, it arose from meetings between DeMint, who chairs the Republican Steering Committee in the Senate, and Hensarling, who chairs the Republican Study Committee in the House. Both organizations are the hub for conservative efforts in the chambers, and following the disastrous 2006 election, DeMint and Hensarling began holding meetings in an effort to better coordinate their efforts.
Eventually, the two began to bring other lawmakers into these Member-only meetings. Following months of discussion, the group decided to start the caucus, choosing a name that would invoke the core fiscal principles of former President Ronald Reagan for the 21st century.

JUST before Congress adjourned for its August recess, Democrats engaged in a flurry of legislative activity, while Republicans complained about a �do-nothing� Congress�s meager policy accomplishments. Deep partisan differences, narrow majorities and a Republican in the White House have frustrated Democratic ambitions and fueled a toxic atmosphere in both chambers of Congress. The public�s low approval ratings reflect broad discontent with the direction of the country but also displeasure with Congress for failing to reverse course on Iraq and for continuing the bitter partisan warfare.
But has this really been a do-nothing Congress? The circumstances are similar to those in 1995, when a new Republican majority in both houses took office under a Democratic president. So perhaps the best question to ask is, how is this 110th Congress doing compared with the 104th Congress, in 1995?
Both new majorities began by spending more time in session, holding more committee meetings and roll call votes, and passing more substantive measures than the Congress before them had. At the same time, in both cases, the number of bills signed into law by the president from January to August dropped.
Still, the Democratic Congress�s legislative harvest this year has been bountiful compared with that of its Republican counterpart in 1995. Back then, the Republicans� Contract With America was stymied by opposition from the Senate and the president. The new Congress has enacted a far-reaching lobbying and ethics reform bill, an increase in the minimum wage, recommendations of the 9/11 Commission, foreign investment rules and a competitiveness package, and has embedded a number of major initiatives and new priorities in continuing and supplemental spending bills. Democrats also made headway on energy, children�s health insurance, college student loans, Head Start, drug safety and a farm bill � though much of this awaits action in the Senate or in conference and faces a possible veto.
During the first seven months of 1995, Congressional oversight of the executive branch increased modestly in the Senate but not at all in the House. But this year Congress, especially the House, has intensified its oversight, following years of inattention and deference by its Republican predecessor.
Democratic promises to restore civility and regular parliamentary procedure by allowing the minority party a larger role in deliberations have foundered. The number of restrictive rules for debate has increased, and the conference process has been short-circuited on various occasions.
In the Senate, Republicans have made the filibuster, or the threat of filibuster, routine, setting a 60-vote hurdle for all contested legislative matters. This has led Harry Reid of Nevada, the majority leader, to file many more petitions for cloture than Bob Dole, his counterpart in 1995, did.
The chart below shows what the 110th Congress accomplished before it closed for its August recess, compared with its immediate predecessor and with the Republican Congress that took office in 1995.

My company is offering my retention contract for 3 years. As I told them that my GC can take long and I haven't filed for I-485 to use AC-21, I will be in trouble if a loose my job. Based on that they are making a written promose that I will have a same job for the next 3 years with all benifits and the only reason I can loose my job is through a decipline action (bad performance, fight, harrasment, etc).
I want to ask the attorney's and gurus if there is such a contract exist and does it have any value ?

I recently received an e-mail from my Lawyers about notification of H-1B Approval Notice (I-797).
My Masters OPT has expired in January 2009. Hence, I enrolled in a degree at a new school to get CPT work permit. My CPT work permit is expiring on 05/09/09.
As my H1-B petition is approved and the change of status has been applied, I came to know that my F-1 status is terminated, when I went to school to get updated I-20, with the new work permit.
What can I do at this moment, to get work permit.
Am I eligible for "Cap-Gap" relief?

I am working for a small company on H1B since October 2006. The company had originally filed for full time employment (LCA and I-129) but at the time of hiring offered part time employment. I worked part time till June 2008 and since then I have been working full time. The company however never filed for an amended LCA and/or I-129 and I worked part-time on a full-time LCA and I-129. My H1B approval was extended last October by another 3 years. I also work part-time for a University on a concurrent H1B.
Will I be deemed out of status for this? What are the implications of this on filing for GC under EB1 or EB2? Is there any way in which this situation may be legally rectified?
Please advise.

NSC must have used up all the FY2007 visas...if not and they did not work on the last day of FY2007, then we can conclude that they really don't care if visas are wasted or not.
Do not expect any approval from NSC today....we can only expect automatic uptdates!
