The U.S. Department of State has published an alert (here (http://travel.state.gov/travel/cis_pa_tw/pa/pa_3250.html)) for U.S. citizens traveling to or residing in South Africa to safety and security issues related to the FIFA World Cup taking place in nine cities across the country from June 11 to July 11, 2010.

She can't work and you can't apply for work permit. You need to wait for the I-130 approval. Then AFTER you become a U.S. Citizen, she will be able to apply for I-485 Adjustment of Status and only at that time you will be able to apply for work permit. By the way. If the I130 is approved and she goes out of country and then tries to re-enter the U.S. on a B-2 visa, she may be denied entry based on Immigrant Intent, for which B1/B2 visa does not allow. Do some research.

Hi,
My H1B 6 years will be finished in February. My I140/485 were filed in August and I will be laid off on December 31. What options do I have now?
- My employer had filed my immigration papers at my current work location. They are willing to relocate me to different location but are not sure on the impact of change in address. Can I relocate with my current 140/485 filed for current address?
- Can my H1 be extended based on approved labor? I can then move to new location with same employer on renewed H1B and start the entire process again?

I am starting this thread for the people who are Greencard Holders and not married. Please share some thoughts for bringing their spouse here.
IV can help in this matter.
If all visa holders and citizens can bring their spouse instantly then why GC holder have to wait for many years after getting GC after many years.

Most people have now heard about Stephen Colbert's testimony in front of the House Immigration Subcommittee this week on the subject of new laws for migrant farmworkers. Some have criticized the Committee for letting the comedian speak. I say, how high can the standards be if they let me testify? My friend Stuart Anderson of the National Foundation for American Policy has a thoughtful piece explaining why the testimony was helpful. Here's the video link if you missed the testimony.

I would like to know can i change employer after my i-140 got approved.My i-140 got approved 6 months back and i have h1 until next year
You can shift to new employer and start the GC process again. The approved I-140 is useful to retain the PD if not revoked. Otherwise no use.

My friend's company is India recently applied for his L1B visa. He is scheduled to go for stamping next week. But, another company has already premium-filed his H1B petition and is expected to hear back from the USCIS anytime now.
Here's the question: if he gets his L1B visa first, can he later on try and get his H1B visa and enter the country with the H1 visa? Second, if he goes for H1B stamping right after his L1B stamping, will it affect the visa officer's decision in issuing a H1 visa?
Last question: he has already spent 3 years in the US on a L1B visa. So, if he comes here on a H1B visa, will the 6-year term limit count his 3 yr. stay on L1 visa or will a new clock start when he enters on H1?

Our I-485 applications were received by Texas Lock box on September 24th. I have not received the receipt number yet. We are leaving to India on Nov 20th for vacation, its quite stressful because we need that receipt before we travel.

The work order my employer has states that my work with the client ends June end, with a possibility of extension. if i file my h1b now, will i be a good candidate for rejection , considering that I do not have a long term project? Also, how true is it that the USCIS is giving visas out only for 1 year under such circumstances, as opposed to the regular 3 years term, and if true, how do I avoid it
Lastly, what is your take on how H1 filings on Apr 1 2010 will be? Is it expected to the same as last year, or will companies file left right and center on day 1 itself?

I understand the wages lesser than specified in Labor is a real potential issue. But what about wages much higher than specified? 10-20% increase will be fine, but what about 50% or 100% jump.
Many of us live in consulting world and in a billing sharing mechanism where your annual wages fluctuates. I am talking to a potential client which can give me a significant raise (please note I am not transferring H1 or using EAD and will be staying with the same GC filing company with 140 approved and 485 pending).
Has anyone ever met a real case when high wage jump created a problem?

this is probably posted before but i'm too lazy to search it...when you using flash with flash wb, the image seems to warm, kinda yellowish...but use auto wb, the pic is more cool and seems right...what do you think?

If you have a phd, is it automatically EB1? or do the rules of employment should call for phd apply?
