    1. When I apply for a new H1B after 1 year break, does the H1B comes under the quota or will it be considered on previously held H1B quota.

It will be counted in the quota

    2. How sure about getting approval of H1B.

Well, if you have a job offer for which you qualify and all relevant supporting documents, I dont see why you wont get the approval.

    Hi,
Currently I am working for employer A on H1B. I have applied for I-485 and have EAD. I have one permanent opprtunity from a consulting firms B. Compnay B is asking me to join on EAD. But threir current client is in Canada. So compnay B want me to travel to Canada, every week, retun back to US in week end. Can I do this while working on EAD. I am just worried wether it will cause any problem. They told that that is the reason they do not want to do H1B.

I tried calling Nebraska Service Center using the 1-800 number and then entering the POJ options. But it seems USCIS has a new system in place and there's no way to reach the Service Center anymore.

Looks like they ended another means of communication---no more POJ? Please correct me, if someone knows the new options. Thanks!

    Hi
    Can someone clarify my issue.

I applied for H1-b in 2008(I was in L1 when i applied). My employer never gave me my recipt number and i didnt even knw the status for a while ( though he said he applied without COS).Later he told it was applied with COS.
Later after numberous calls and mail he gave me a recipt number ,but the
status on USCIS website was "Notice Undelivered as of June 2008".

I could never find ,whether it was RFE or Approved status.I called up USCIS they said employer has to call to confirm the status. My employer said he will follow up with USCIS but he never did and he is absconding now .I cant reach him ,no phone,no mails. So i continued on L1.

Since my extension is coming up.I wanted to make sure my status hasnt changed because of this issue.
Has anyone faced this situation? Had that notice (undelivered) been an approval letter ,would that change my status though it was never accepted (Its undelivered as of Jun 2008)

    Thanks

My EAD got approved today. It is in card production stage.
I am wondering if mutli year EAD if effective immediately. If so, I will be getting EAD that is valid for 3 yrs or mutli years right?

    Friends, I appreciates your inputs.

Wondering what the impact will be for 140 processing with the revised bulletin. Mine EB-2 has been pending in TSC for the last 5 months. It's my understanding we cannot use the AC-21 provisions like switching jobs without approved 140.

If 140 processing goes up to a year that would be really bad for new applicants. Atleast they should resume Premium processing. Any thoughts?

The law requires that you report any and all change of address change within 10 days of the change.
You can choose to use the online tool and complete an electronic Form AR-11 and notify USCIS to update your address on most pending cases. However, if you choose to do it by paper, then AR-11 will not update your address on any applications or petitions pending with USCIS.
    Hope this helps.

    Hi friends,

Today I had a LUD on my old I-129 (approved in Aug 2005). The online status say: On August 29, 2007, the post office returned our last written notice on this case as undeliverable. This can have serious effects on the processing of this case. Please call 1-800-375-5283 to update the mailing address so this notice can be re-sent.

I'm no more working for this employer and Ive changed to a new employer a year ago. What does this status mean?Any ideas?

Does this cause any problem to my current GC process which was sponsored by current employer?

    Guys,

My company is forcing everyone to fill I9 form. I have EAD but maintaining H1 status and did not use EAD. I did some research on I9 and it is no where mentioned that only people with EAD has to fill this. I need Guru's opinion on this.

I just don't want to loose my H1 status in any case.

    Hi,

My I-485 was filed in June'2007 in Nebraska service centre since my company is based in Michigan. I live in PA.

I am filing my EAD now but according to the latest instructions for EAD, the filing centre should be decided based on where you live. So for PA, the filing centre listed is Texas.

My question is should I file in Texas based on where I live or in Nebraska where my I-485 case was filed. The USCIS case tracker also says that my case is at Nebraska.

    Thanks
    Sanjeev

I have a PD of September 2007 in the EB-2 category. I am currently on an H1B 3 year extension(after 6 years) on basis of an approved I-140.I am a physician and would like to pursue a fellowship given that it is unclear how many years I will have to wait to get a green card. Can I extend the H1B (change employer),given that I got the 3 year extension of the H1b on the basis of an approved I-140? What are the consequences for the H1B visa (employer change).I know I may have to start my green card process all over again.Thank you.
